Hereinafter referred to as the "Electronic Bidding System." 2. Qualifications Required for Bidders Those who meet all of the following requirements: (1) Must have their head office in Toyonaka City. (2) Not subject to the provisions of Article 167-4 of the Enforcement Order. (3) Must have received certification for electrical work in the Toyonaka City Construction Work Bidding Qualifications as of the announcement date. However, this applies only to those who indicated "1" as their desired order of preference for electrical work certification on the contractor registration card submitted at the time of certification. (4) Not subject to an 営業停止 (business suspension) order under the Construction Industry Act (Showa 24 Law No. 100). (5) Not subject to bidding suspension measures based on the "Toyonaka City Bidding Participation Suspension Standards" (established June 1, Heisei 7) from this city. (6) Not subject to exclusion measures from bidding based on the "Toyonaka City Contract Exclusion Measures for Gangsters, etc. (established February 1, Heisei 24)" from this city. (7) For electrical work, the comprehensive evaluation score (latest) on the "Management Scale Evaluation Results Notification Letter and Comprehensive Evaluation Score Notification Letter" must be 550 points or higher. (8) Must have a construction industry permit based on the Construction Industry Act for electrical work. (9) Must have experience as the prime contractor in constructing a complete set of electrical work with a contract amount of ¥26,000,000 (including consumption tax and local consumption tax) or more per contract (completed by the bid date). (10) Must be able to assign a site manager to the construction site at the time of contract signing for this construction. However, this applies to individuals who have had a direct and continuous employment relationship for 3 months or more as of the submission date of the application for participation in this open competition bidding, and who are not the person in charge of management operations or the専任技術者 (full-time technician) of the business office. (11) Must be able to appropriately assign a chief engineer or supervising engineer corresponding to electrical work based on the Construction Industry Act at the time of contract signing for this construction. However, this applies to individuals who have had a direct and continuous employment relationship for 3 months or more as of the submission date of the application for participation in this open competition bidding (in cases where a chief engineer or supervising engineer must be exclusively assigned to the construction site, this applies to those who are not the person in charge of management operations or the専任技術者 of the business office). (12) Must have obtained an electronic certificate (IC card) under Article 13, Paragraph 1, Item 1 of the Regulations for the Enforcement of the Electronic Signature and Certification Business Act (Reiwa 13, Ministry of Internal Affairs and Communications, Ministry of Justice, Ministry of Economy, Trade and Industry Ordinance No. 2) and completed registration (user registration) for using the electronic bidding system through the electronic bidding system by the end of the application document and bid submission period for this bidding. (13) Not subject to an order to commence reorganization proceedings under Article 381, Paragraph 1 of the Commercial Code (Meiji 32 Law No. 48) as amended by Article 64 of the Act for the Partial Amendment of Related Laws due to the Enforcement of the Companies Act (Heisei 17 Law No. 87) (including cases where the former provisions still apply under Article 107 of the Act for the Partial Amendment of Related Laws due to the Enforcement of the Companies Act). (14) Not a person who has filed for conciliation proceedings under Article 12, Paragraph 1 of the Conciliation Act (Taisho 11 Law No. 72), which was repealed by Appendix Article 2 of the Civil Rehabilitation Act (Heisei 11 Law No. 225), before March 31, Reiwa 12. (15) Not a person who has filed for or had filed against them a petition for commencement of rehabilitation proceedings under Article 21, Paragraph 1 or 2 of the Civil Rehabilitation Act (Heisei 11 Law No. 225) on or after April 1, Reiwa 12. However, a person who has received a decision to commence rehabilitation proceedings under Article 33, Paragraph 1 of the same Act shall be deemed not to have filed for commencement of rehabilitation proceedings or not to have had such proceedings filed against them if a decision to approve the rehabilitation plan under Article 174, Paragraph 1 of the same Act has become final. (16) Not a person who has filed or had filed against them a petition for commencement of rehabilitation proceedings under Article 17, Paragraph 1 or 2 of the Corporate Rehabilitation Act (Heisei 14 Law No. 154) (including petitions for commencement of rehabilitation proceedings under Article 30, Paragraph 1 or 2 of the former Corporate Rehabilitation Act (Showa 27 Law No. 172; hereinafter referred to as "former Act") related to rehabilitation cases for which the former provisions still apply under Appendix Article 2 of the same Act (hereinafter referred to as "petition for commencement of rehabilitation proceedings")). However, a person who has received a decision to commence rehabilitation proceedings under Article 41, Paragraph 1 of the Corporate Rehabilitation Act (including a decision to commence rehabilitation proceedings under the former Act related to former rehabilitation cases) shall be deemed not to have filed for commencement of rehabilitation proceedings or not to have had such proceedings filed against them if a decision to approve the rehabilitation plan under Article 199, Paragraph 1 of the Corporate Rehabilitation Act (including a decision to approve the rehabilitation plan under the former Act related to former rehabilitation cases) has become final. 3. Application Restrictions Notwithstanding the provisions of 2, the following persons are not permitted to participate in this bidding: (1) Successful bidder candidate for Reiwa 8 Fiscal Year LED Road Lighting (Crime Prevention Light) Renewal Construction (Section 4) Part 2, announced by Toyonaka City Public Notice No. 435, successful bidder candidate for Reiwa 8 Fiscal Year LED Road Lighting (Crime Prevention Light) Renewal Construction (Section 2) Part 2, announced by Toyonaka City Public Notice No. 436, or successful bidder candidate for Reiwa 8 Fiscal Year LED Road Lighting (Crime Prevention Light) Renewal Construction (Section 1) Part 2, announced by Toyonaka City Public Notice No. 437. (2) Persons who have been awarded 6 or more contracts for works with an estimated price of ¥30,000,000 or more (hereinafter referred to as "works of ¥30,000,000 or more") (limited to those not yet completed) that have been put out to tender by this city (including the Waterworks and Sewerage Bureau and Toyonaka Municipal Hospital) through open competition bidding (excluding bids by specific construction joint ventures) or designated competitive bidding, as of the announcement date. However, this number shall be 7 or more for those who have obtained a construction performance score of 80 or higher in the completion inspection by this city for works of ¥30,000,000 or more completed within one year prior to the announcement date (excluding those who have obtained a construction performance score of less than 60 in the completion inspection by this city for works of ¥30,000,000 or more completed within one year prior to the announcement date). (3) Persons whose total contract amount for works of ¥30,000,000 or more (limited to those not yet completed) as of the announcement date is equal to or greater than the construction amount specified in the table according to the grade related to the certification prescribed in 2.(3). However, the following cases are excluded from the total contract amount: A. The contract amount for works that are not yet completed due to a change in contract for extension of the construction period for reasons not attributable to the contractor. B. The amount of work completed based on the progress at the end of each fiscal year, when the construction period spans multiple fiscal years. (4) Persons who have obtained a construction performance score of less than 60 in the completion inspection by this city for works of ¥30,000,000 or more completed within one year prior to the announcement date (excluding those who have obtained a construction performance score of 80 or higher in the completion inspection by this city for works of ¥30,000,000 or more completed within one year prior to the announcement date), and for whom 6 months have not yet passed since the completion date of the work of ¥30,000,000 or more for which the construction performance score of less than 60 was obtained. 4. Distribution of Location Map, Design Drawings, Summary Table, General Specifications, Special Specifications, Site Description, List of Submitted Documents, Toyonaka City Electronic Bidding Operation Standards, and Toyonaka City Construction Contract Electronic Bidding Code of Conduct (Ex-post Review Method) (hereinafter referred to as "Design Documents, etc.") (1) Distribution of Design Documents, etc.: A. Those who do not submit the Qualification Examination Documents by the deadline will lose their status as a successful bidder candidate. C. Distribution Method: Documents (A), (D), and (E) will be provided via the Electronic Bidding System. D. If the work is registered in the "Construction Performance Information Service (CORINS)" of the Japan Construction Information Center Foundation, document (6)A(B) is not required. F. If the comprehensive evaluation score (latest) on the "Management Scale Evaluation Results Notification Letter and Comprehensive Evaluation Score Notification Letter" can be confirmed on the website of the Construction Industry Information Management Center Foundation, a copy of the "Management Scale Evaluation Results Notification Letter and Comprehensive Evaluation Score Notification Letter" (6)A(C) is not required. 7. Bidding Method, etc. (1) When a person falling under 3.(1) submits a bid document for this construction using the method specified in 6.(4), "Invalid" will be displayed on the electronic bidding system. (2) For the determination of the successful bidder, the bid amount written on the bid document, plus an amount equivalent to 10% of that amount (if there is a fraction of less than 1 yen, that fraction will be rounded down), will be the successful bid amount. Therefore, bidders must write the amount equivalent to 100/110 of their estimated contract desired amount on the bid document, regardless of whether they are a taxable or tax-exempt business operator for consumption tax and local consumption tax. (3) The number of bids is limited to one. (4) A minimum reserve price will be set for this bidding in accordance with the provisions of Article 167-10, Paragraph 2 of the Enforcement Order. (5) The estimated price and minimum reserve price will be announced at the time of bid opening. (6) The bidding results will be announced at the time the successful bidder candidate is determined. 8. Determination of Successful Bidder As a result of the bid opening, the person who submitted the lowest bid price within the range of the estimated price and the minimum reserve price (if there are two or more persons who submitted the same bid price that would be the successful bid, the successful bidder will be determined by a lottery through the electronic bidding system) will be the successful bidder candidate. After the qualification examination for bidding participation is conducted using the Qualification Examination Documents submitted in accordance with 6.(6), if the bidder is recognized to have the qualification, they will be determined as the successful bidder. However, if the successful bidder candidate is deemed not to have the qualification for bidding participation, the next ranked successful bidder candidate will be sequentially examined for bidding qualification, and the successful bidder will be determined. 9.
