Matters Concerning Qualifications Required for Bidders Bidders who meet all of the following requirements and whose qualifications have been confirmed will be eligible to participate in this tender. (1) Not a person falling under the provisions of Article 167-4 of the Local Autonomy Act Enforcement Order. (2) Not a person who has filed or has had filed against them a petition for commencement of rehabilitation proceedings under Article 21, Paragraph 1 or 2 of the Civil Rehabilitation Act (Act No. 225 of 1999). However, for a person who has received a decision to commence rehabilitation proceedings under Article 33, Paragraph 1 of the same Act, if a decision to approve the rehabilitation plan under Article 174, Paragraph 1 of the same Act has become final, they shall be deemed as a person who has not filed or had filed against them a petition for commencement of rehabilitation proceedings. (3) Not a person who has filed or has had filed against them a petition for commencement of rehabilitation proceedings under Article 17, Paragraph 1 or 2 of the Corporate Reorganization Act (Act No. 154 of 2002) (including petitions for commencement of rehabilitation proceedings under Article 30, Paragraph 1 or 2 of the former Corporate Reorganization Act (Act No. 172 of 1952; hereinafter referred to as "former Act") concerning rehabilitation cases that are still governed by the former Act pursuant to the provisions of Article 2 of the Supplementary Provisions of the same Act). Determination of Successful Bidder A. In this tender, the successful bidder will be the one who submits the lowest bid within the limit of the estimated price, or if a minimum reserve price is set in advance in accordance with Article 167-10, Paragraph 2 of the Local Autonomy Act Enforcement Order, the one who submits the lowest bid among those who submit bids at or above the minimum reserve price within the limit of the estimated price. B. If there are two or more bids with the same lowest price, the successful bidder will be determined by lottery. 8.
