Er is n.a.v. deze Aankondiging geen civiel kort geding aanhangig gemaakt, zodat de opdracht definitief gegund is en alle rechten van belanghebbenden om tegen de gunning op te komen zijn vervallen. Tekst Aankondiging van vrijwillige transparantie vooraf, zoals eerder gepubliceerd: Waterschap Rivierenland (hierna WSRL) beschikt over een Centrale Regie in Tiel. Sturing in onder meer de afvalwaterketen kan verder geprofessionaliseerd worden door het inzetten van software. Om verder invulling te geven aan de digitale transformatie wenst WSRL een verdere implementatie van de applicatie Aquasuite Flow, waardoor d.m.v. slimme geavanceerde AI-software het afvalwatertransport naar de rwzi’s aanzienlijk verbetert. WSRL heeft voor deze dienstverlening eveneens onderzoek gedaan naar de mededinging op het gebied van de AI-software m.b.t. de slibverwerking. Er lijkt op dit moment geen passende gelijkwaardige beproefde oplossing op de markt te zijn die aansluit op de eisen van WSRL, waarbij opgemerkt dient te worden dat de technische SCADA en Centrale Gegevens Opslag systemen nog een lange technische levensduur hebben. WSRL wenst tevens uitbreiding op het Aquasuite product voor het onderdeel Mine. Op basis van het voorgaande concluderen wij dat het zinvol is de opdracht door dezelfde leverancier uit te laten voeren. WSRL is voornemens om de opdracht te gunnen aan Royal HaskoningDHV. Gezien de hoogte van de investering, is er sprake van een lange looptijd van de overeenkomst (inclusief beheer). WSRL kiest voor toepassing van een onderhandelingsprocedure zonder aankondiging op grond van art. 2.32 tot en met 2.36 Aanbestedingswet 2012, omdat: - mededinging om technische reden ontbreekt (art. 2.32 AW, lid 1b, tweede bullet); - er daarnaast is sprake van uitsluitende rechten (art. 2.32 AW, lid 1b, derde bullet). Er is geen andere partij bekend die deze opdracht kan uitvoeren; er bestaat geen redelijk alternatief of substituut. Belanghebbenden kunnen tegen dit voornemen opkomen door middel van een civiel kort geding. Deze procedure dient binnen een termijn van 20 kalenderdagen na publicatie van deze aankondiging van vrijwillige transparantie aanhangig te worden gemaakt. Indien niet tijdig een kort geding aanhangig wordt gemaakt, zal de opdracht definitief gegund worden en vervallen alle rechten van belanghebbenden om tegen de gunning op te komen. Indien tijdig een kort geding aanhangig wordt gemaakt, wordt de definitieve gunning uitgesteld totdat de rechter uitspraak heeft gedaan.
