Conclusion of a non-exclusive discount agreement according to § 130a para. 8 SGB V for the active ingredient Ticagrelor, ATC B01AC24 for the period 01.06.2025 - 31.05.2027 (plus 1x12 months extension option)

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel public procurement law due to a lack of selection decision and thus the non-discriminatory access for all pharmaceutical companies. Regardless, it automatically ends upon the entry into force of the exclusive contract for Ticagrelor, ATC B01AC24, as a result of a formal procurement procedure according to the regulations of the 4th part of the GWB with one or more contractual partners. In order to accommodate the diversity of potential contractual partners within the framework of the approval model, every pharmaceutical company is enabled to conclude a framework agreement at any time and under the same conditions during the contract term. The necessary contractual documents for this are available for download via the online portal www.dtvp.de/center under the link mentioned in 5.1.11. Prerequisites for the conclusion, or later accession, to the contracts that initially come into force on 01.06.2025 are the complete and timely submission of the following documents (available for download under the link mentioned in 5.1.11.) to the following department at DAK-Gesundheit: 1. Offer letter 2. Acceptance of the contractual provisions of DAK-Gesundheit, especially also the specified discounts, by submitting the contract signed by name or company stamp by the interested party in the designated place. 3. The completed Annexes 1 and 2 to the contract. The interested party must enter the medicines for the above-mentioned active ingredient that will be the subject of the contract here. The documents must be submitted BY EMAIL to: openhouse@dak.de DAK-Gesundheit Department for Medicines (0038 00) Nagelsweg 27-31 20097 Hamburg Annex 2 must be explicitly sent as an Excel file to the email address openhouse@dak.de. Contracts within the framework of this model and for the above-mentioned active ingredient will be concluded for the first time with effect from 01.06.2025 and will end on 31.05.2027 (plus 1x12 months extension option). Interested parties who wish to become contractual partners by this date must submit the above-mentioned documents to be submitted by the 5th of the preceding month BY EMAIL. The offer must be submitted in text form as an electronic offer BY EMAIL to openhouse@dak.de. Submission of the offer by post is not planned in this procedure. Please DO NOT submit the offer via the German Procurement Portal. For timely submission, an electronic receipt of the complete documents BY EMAIL to the email address openhouse@dak.de is sufficient. Later accessions are possible at any time. In order to be able to join on the 1st or 15th of the following month during the contract term, the above-mentioned documents must be available to DAK-Gesundheit by the 5th of the preceding month, regardless of the desired accession date. Here too, timely receipt by email at DAK-G is crucial. Example: The accession desired by the bidder is to take place on 15.07. (following month); the documents would have to be available by 05.06. (preceding month). Note: The publication is made here using the form for open procedures. As already clarified, this is not such a procedure - the notice had to be used for technical reasons, as there is no suitable form for approval procedures.
