Original language: GermanDie GWQ ServicePlus AG beabsichtigt, nichtexklusive Rabattvereinbarungen nach § 130a Abs. 8 SGB V zu dem o. a. Wirkstoff mit Vertragsstart zum 01.07.2026 zu schließen. Diesem Vertrag können zu jeder Zeit der Vertragslaufzeit alle interessierten Unternehmen zu den gleichen Bedingungen beitreten (Zulassungsmodell). Die GWQ geht davon aus, dass dieses Verfahren auf Grund einer fehlenden Auswahlentscheidung und mithin der diskriminierungsfreien Zugangsmöglichkeit aller pharmazeutischen Unternehmen nicht in den Anwendungsbereich des Kartellvergaberechts fällt. Die Vertragsunterlagen, die teilnehmenden Krankenkassen und deren Umsätze sowie die Termine für die Meldung des Vertrags sind auf dem Vergabeportal der GWQ ServicePlus AG unter https://vergabeportal.gwq-serviceplus.de/arzneimittel einzusehen und herunterzuladen. Bis zum Start exklusiver Verträge steht diese Übergangsvereinbarung allen Marktteilnehmern zum Beitritt offen.
