In the event of a tie in the final evaluation result, priority will be given, in the first instance, to the offer that obtained the highest score in the "price" evaluation criterion; should this equality persist, the scores of the remaining evaluation criteria will continue to be compared, according to the importance assigned in their weighting. In the event that the tie is still maintained after applying this rule, the award will be made to the bidder who submitted their offer first on the www.mercadopublico.cl portal, in accordance with the offer submission certificate issued by the aforementioned portal. Interested parties may make inquiries regarding the award, within the fatal period of 2 calendar days following the respective notification of the act, inquiries that will be made via email to adquisiciones@gendarmeria.cl, indicating the name of the proponent, email address, and the name and ID of the proposal. Responses will be sent within 5 calendar days following the publication of the resolution, via email addressed to the provider who submitted the inquiry. Along with the sending of said email and within the same period, the questions and answers will be published as an annex to the tender. Gendarmería de Chile will have no labor or legal connection whatsoever with the employees working for the provider. However, and in accordance with the provisions of article 4 of the purchasing law, and article 183-C of the Labor Code, the provider will be required to submit a certificate accrediting the amount and status of compliance with the labor and social security obligations of said workers, issued by the respective Labor Inspection, or by means that guarantee the veracity of such data. The same requirement will apply to the provider's eventual subcontractors, in relation to their workers. The foregoing, for the purpose of enforcing the rights of information and retention that Gendarmería de Chile holds and which are enshrined in the first and third paragraphs of the aforementioned norm of the Labor Code, within the framework of the subsidiary responsibility derived from said labor and social security obligations, to which article 183-D of the same legal body refers.
