In case of a tie between two or more bidders regarding the total score obtained in the evaluation of offers for a particular product, the following evaluation criteria scores will be used as a tie-breaker, in the following order of preference: -The offer that has obtained the highest score in the Price criterion will be chosen; -The offer that has obtained the highest score in the Technical Evaluation criterion will be chosen; -The offer that has obtained the highest score in the Contractual Performance criterion will be chosen; -The offer that has obtained the highest score in the Integrity and Compliance criterion will be chosen; -The offer that has obtained the highest score in the Delivery and Replenishment Time of Supplies criterion will be chosen; -The offer that has obtained the highest score in the Formal Requirements Compliance criterion will be chosen. Finally, in case the tie persists, it will be awarded to the bidder who submitted their offer first on www.mercadopublico.cl, considering the date and time of submission of their offer. Bidders and, subsequently, the awarded supplier, declare that by the mere fact of participating in this tender, they expressly accept this integrity pact, undertaking to comply with each and every one of the stipulations contained therein, without prejudice to those indicated in the rest of the tender documents and other integral documents. Specifically, they agree to provide all information and documentation that is considered necessary and required in accordance with these tender documents, expressly assuming the following commitments: a. Respect the fundamental rights of their workers, understood as those enshrined in Article 19, numbers 1, 4, 5, 6, 12, and 16 of the Political Constitution of the Republic, in accordance with Article 485 of the Labor Code. Likewise, the awarded supplier undertakes to respect human rights, which means that they must avoid giving rise to or contributing to adverse effects on human rights through their activities, products or services, and remedy those effects when they occur, in accordance with the UN Guiding Principles on Business and Human Rights. b.
