Subject of the Contract: Purchase of 1 new SP18-4 submersible pump or technically equivalent for drinking water production. Only new (unused/first-time commissioned) devices can be offered. The winning bidder is responsible for the transport of the defective device from and to the site in case of a defect covered by the warranty during the warranty period undertaken by them. The winning bidder must also undertake to return the repaired and operational device or replacement device to the Ordering Party's site within 30 working days at the latest from the confirmation of the defect report by the winning bidder. The Ordering Party will commission the delivered pump within a maximum of 6 months after delivery, for which a written commissioning protocol will be prepared. The warranty undertaken by the bidder starts after commissioning by the Ordering Party. If the Ordering Party does not commission the pump within 6 months of delivery, the warranty period begins on the corresponding day of the 6th calendar month after delivery. Requirements for the pump: detailed technical requirements and parameters, and possibilities for deviation are included in the Technical Description and the Procurement Documents. The Ordering Party draws the bidder's attention to the fact that the accuracy of the individual technical data sheets can be verified by the Ordering Party based on the manufacturer's official data, within which framework the Ordering Party may also request a declaration or document from the manufacturer from the bidder. If the bidder offers a product with parameters different from the requirements specified in the table, the Ordering Party will consider the product acceptable if its technical parameters meet the requirements detailed in the Technical Description and Procurement Documents. The Ordering Party reserves the right to carry out a documented test bench measurement on randomly selected pumps at an independent organization within 15 days of order fulfillment if doubts arise regarding the authenticity of the offered operating parameters. The Ordering Party will measure the ordered, delivered pump during its commissioning. If the measured data do not match the parameters given in the LCC table, the Ordering Party will withdraw from the purchase right and return the delivered pumps to the bidder's site (costs to be borne by the bidder). If the technical description, which is part of the procurement documents, also includes manufacturer and type designations, the Ordering Party will also accept offers equivalent to the given manufacturer and type in accordance with § 46 (3)-(6) of Government Decree No. 321/2015 (X.30.). The bidder is responsible for proving equivalence. Details are provided in the Technical Description and the draft Sales Agreement.
