In the event that, after the offer evaluation process is completed, two or more proponents have obtained the same maximum score, leaving more than one in a position to be awarded the contract, the offer that has a higher score according to the following sequence will be chosen, with the criteria that are applicable:

Failure by the awardee to comply with these obligations will entitle the termination of the contractual relationship, and a new tender may be called in which the referred awardee may not participate.
