In the event that, after the evaluation of offers, two or more bidders obtain the same maximum total score, leaving more than one in a position to be awarded, the following tie-breaking criteria will be applied, in the order indicated:

Preference will be given to the offer that obtains a higher score in the Economic Offer criterion.

If the tie persists, the offer with the highest score in the Bidder Experience criterion will be selected.

If the tie continues, the offer that obtains the highest score in the Formal Requirements criterion will be chosen.

If the tie persists, the offer that obtains the highest score in the Integrity Compliance criterion will be selected.

Finally, if the tie persists, the award will be given to the offer with the longest seniority of entry into the Public Market Information System.

During the term of the respective contract, the awarded bidder must prove that they have no outstanding balances of remuneration or social security contributions with their current workers or with workers hired in the last two years. This is without prejudice to the obligations that may be required in this regard to authorize the payment of the corresponding installment during the development of the services. This declaration must be submitted when half of the contract execution period is completed, with a maximum of six months. In the case of a Temporary Union of Suppliers (UTP), it must be submitted by each member of it.

To prove compliance with the foregoing, the awarded bidder must submit during the term of the contract, for each monthly payment, the “Certificate of Compliance with Labor and Social Security Obligations”, issued by the Labor Directorate or, failing that, a sworn statement indicating that “no outstanding balances of remuneration or social security contributions exist with their current workers or with workers hired in the last two years” according to the format in Annex No. 3 “Sworn Statement for Contracting”.

The foundation may request the awarded bidder, at any time, the documentation it deems necessary to prove compliance with the aforementioned labor and social obligations, within the framework permitted by applicable national or international regulations.
