Original language: GermanDieser Vertrag dient der Sicherheit innerhalb von bayerischen Justizgebäuden. Prozessbeteiligte, Mitarbeiter der Justiz, Besucher und sonstige Befugte sollen sich in Gerichtsgebäuden gefahrlos aufhalten können. Aus diesem Grund muss regelmäßig vor Zutritt in ein Gerichtsgebäude eine gründliche Kontrolle nach gefährlichen Gegenständen – insbesondere nach Waffen – erfolgen. Andererseits darf der Grundsatz der Öffentlichkeit nicht eingeschränkt werden, vgl. Art. 6 Abs. 1 Menschenrechtskonvention, § 169 Abs. 1 Satz 1 Gerichtsverfassungsgesetz. „Offene“ und zugleich sichere Gerichte können nur durch gewissenhaft arbeitende, korrekte und qualifizierte Sicherheitskräfte in ausreichender Anzahl gewährleistet werden. Neben dem Personal aus dem Justizwachtmeisterbereich sollen hierfür auch private Sicherheitsunternehmen tätig werden. Die objektive und auch subjektive Sicherheit in den Gerichten setzt die Anwesenheit von Sicherheitskräften voraus. Eingangskontrollen mit Durchsuchungen finden indes lediglich für die Dauer der Gerichtsverhandlungen statt. Außerhalb dieser Zeiten sollten bei Bedarf Sicherheitskräfte kurzfristig zur Verfügung stehen. Dieser Vertrag regelt verschiedene Aufgaben, die auch vor, nach oder zwischen Terminen ausgeführt werden können. Sicherheitskräfte sind damit im Bereich der Gerichte tätig und bei Gefahr einsatzbereit. Der Auftragnehmerin soll es gleichzeitig ermöglicht werden, rationell - insbesondere ohne Unterbrechungen - zu arbeiten. Ziel ist, ein hohes Sicherheitsniveau zu gewährleisten und zudem die Gebote des sparsamen und wirtschaftlichen Handelns zu beachten.
