Provision, implementation, and ongoing support of a Computer Aided Facility Management (CAFM) system for Austro Control GmbH

Austro Control GmbH has procured the provision, implementation, and ongoing support of a Computer Aided Facility Management (CAFM) system. The CAFM system is to be used as SaaS (Software as a Service) with unlimited duration. The contract was concluded for an unlimited period, with a twelve (12) month notice period at the end of a calendar year. Furthermore, the contractor can only terminate eight and forty (48) months (= waiver of termination) after the successful initial implementation (= successful implementation of the "Space Management" module), thus at the earliest on 31.03.2030 for 31.12.2031. Procurement law option: The client is entitled to negotiate additional services within the scope of the aforementioned basic contract (fixed call-off; cf. General LV point 1.1) to the extent of up to 80% of the fixed call-off quantity with the contractor of the basic contract in a negotiated procedure without prior publication, provided that the contractor has performed the services according to the basic contract flawlessly and continued service provision by the contractor is technically and/or economically necessary or sensible. The basis for the negotiation is the offered prices in the aforementioned tender, taking into account current price developments. The remuneration for this optional service is to be determined by mutual agreement based on the calculation basis and the agreed inflation-adjusted hourly rates for the basic contract. The maximum price results from the offer for the basic contract and the agreed indexing. This option is available until 31.12.2040.
