Provision/Operation of accommodation for the homeless (Flexi-Heim) Heinrich-Wieland-Straße 99 and 101 for the accommodation of homeless families

The subject of the tender is the provision and operation of 139 beds for homeless families in the accommodation facility (Flexi-Heim) "Heinrich-Wieland-Straße 99 and 101" for a period of ten years. The aforementioned facility serves as the contractual place of performance. In the course of taking over the operator activity, the selected bidder (contractor, AN) will also step into the lease agreement with the owner of the building on behalf of the State Capital Munich (LHM). The property at Heinrich-Wieland-Straße 99 and 101 is a newly built Flexi-Heim for the temporary accommodation of homeless families. Information about the property and the distribution of the total 139 beds can be found in the attached floor plans and the property description. Upon award of the contract, a contractual relationship will be established between the AG and the AN, the contents of which are this service description (Part A) including the special contractual conditions (Part B) and all attachments, as well as all documents submitted by the bidder with the offer. After successful handover of the property, the lease agreement between the AN and the owner will also commence. The relevant lease agreement dated 11.04.2024, already concluded between the owner and the LHM, and the 1st amendment to the lease agreement dated 12.05.2026 are also attached as Annexes 6 and 6a and will become binding contractual components upon award. By submitting an offer, the bidder agrees to conclude two contractual relationships: the service agreement for the provision and operation of 139 beds for homeless families in the accommodation facility "Heinrich-Wieland-Straße 99 and 101" with the AG and the lease agreement with ANDO Vermögensverwaltung GmbH for the same property for the duration of the operation. In their function (operation of the facility), the AN takes on the central role for the processes in the Flexi-Heim and is responsible as the general tenant, in accordance with the division of responsibilities defined in the lease agreement with the owner, for maintaining the flawless condition of the property and its equipment. The tendered service contract for the provision and operation of 139 beds for homeless families in the accommodation facility "Heinrich-Wieland-Straße 99 and 101" will commence upon award of the contract. The start of services is oriented towards the handover of the building by the owner, which will take place after the completion of the building and is planned for September 1, 2026. However, a delay of up to three months cannot be ruled out. Upon successful handover of the property, the 30-year term of the lease agreement between the owner and the LHM will begin. The AN will simultaneously step into the lease agreement in place of the LHM as the tenant, so that at this point all obligations of the AN from the lease agreement, particularly regarding building maintenance and rent payment, will commence for the duration of the service agreement (10 years). Following the handover (and possibly already before), the AN must prepare the property for its intended use as accommodation for the homeless. The necessary furnishing of the property with movable furniture is to be organized by the AN in advance and then carried out under their own responsibility. After successful acceptance of the property by LHM employees and possibly the AN, it will be released as operational accommodation for the homeless.
