In case two or more bidders obtain the same final score as a result of the evaluation carried out by the Evaluation Committee, the tie will be broken according to the following order of priority: a. The bidder who obtains the highest score in the criterion “Technical Proposal”. b. The bidder who obtains the highest score in the criterion “Economic Proposal”. c. The bidder who obtains the highest score in the criterion “Administrative Proposal”. d. The bidder who submitted their offer first. The bidder declares that, by the mere act of participating in this tender, they expressly accept this integrity pact, undertaking to comply with each and every one of the stipulations contained therein, without prejudice to those indicated in the rest of these tender documents and other integral documents. Specifically, the bidder agrees to provide all information and documentation that is considered necessary and required in accordance with these tender documents, expressly assuming the following commitments: a. The bidder commits to respecting the fundamental rights of their workers, understood as those enshrined in the Political Constitution of the Republic of Chile in its article 19, numbers 1°, 4°, 5°, 6°, 12° and 16°, in accordance with article 485 of the Labor Code. b. The bidder undertakes not to offer or grant, nor attempt to offer or grant, bribes, gifts, prizes, gratuities or payments, of whatever type, nature and/or amount, to any public official (regardless of their legal status) and/or any honorary staff in relation to their offer, to the public tender process, nor to the execution of the contract that may arise from it; nor shall they offer or grant them to third parties who could directly or indirectly influence the tender process, its decision-making, or the subsequent award and execution of the contract that derives from it. c. The bidder undertakes not to attempt, nor to make agreements or carry out negotiations, acts or conduct, that aim to influence or affect free competition in any way, regardless of the specific conduct or act; and especially, those agreements, negotiations, discussions, acts and/or conduct of a collusive type or nature, in any of its types or forms. d.
