Public service concession for the management and operation, at the risk and peril of the future concessionaire, of the municipal cinema "Le Grenier d'Alcazar"

The present contract aims to grant, through a public service concession contract, the management and operation of the "Le Grenier d'Alcazar" cinema located at 1 place Thiers, Eyguières, 13 430. The perimeter is defined on the plan attached in Annex 1, mentioned in Article 14. The facility, hereinafter referred to as "the cinema", includes a hall that can accommodate 201 people, including 3 people with reduced mobility. In addition to the hall, the facilities made available to the Operator include: - A PMR elevator accessible from outside the cinema, then a device allowing disabled people to access the cinema hall; - A reception hall equipped with a ticket sales counter; - An office serving a projection booth; - A break room for cinema staff; - Restrooms; - A storage space at the rear of the projection screen. The Operator's missions include: - Public and commercial operation of the facility, in compliance with the orientations defined by the Local Authority: o Public reception 11 months a year at the "Le Grenier de l'Alcazar" cinema within the framework of the annual programming, with the facility being closed during August; o Organizing open-air cinema screenings, from mid-July to mid-August, mainly at the open-air theatre, but, failing that, in other public spaces after authorization from the municipality; o Making the cinema available for one-off events organized by the Local Authority; o Programming and showing a varied and quality film program; o Ensuring the maintenance of the "Art and Essay" label through the labels "Research and Discovery", "Young Audiences", and "Heritage and Repertoire"; o Implementing a local cinema animation project; o Defining actions to develop the local notoriety of the facility: ? Development of partnerships; ? Participation in national or other educational and cultural programs; o Ensuring the commercial management of the concessioned facilities in order to attract an audience of all ages and backgrounds; o Management of ticketing and sales to users (entrance tickets, season tickets, etc.); o Collecting revenue from cinema users; o Managing missions complementary to the activity or the building - Technical operation of the facility: o Surveillance of the cinema; o Technical operation of the facility including, but not limited to, the installations necessary for film projection and viewing; o Provision and management of the material resources necessary for the operation of the facility: projection equipment, IT equipment, ticketing equipment, etc.; o Compliance with regulatory standards; - Administrative and financial management of the service: o Administrative and financial management of the site; o Management of relations with distribution companies; o Taking over the staff assigned to the service in accordance with legal provisions, recruitment if necessary, management and training of the establishment's staff; o Compliance with sanitary, hygiene, and safety standards, and risk and hazard prevention: definition of procedures, awareness and training actions, risk prevention plan, etc.; o Definition of forecasts relating to attendance, operation, management, pricing policy, etc.; o Production of operational documents (operational registers, annual reports, technical and financial reports, etc.); o Conducting communication actions aimed at promoting the cinema; o Definition of safety protocols and drafting of all documents to be produced within the framework of ERP legislation. - A general duty of advice towards the Local Authority
