Concession of a single public service for the management of four early childhood reception facilities with a capacity of 30 places "les Coccinelles" located in Sainte-Anne d'Auray, 20 places "Ty Heol" located in Saint-Philibert, 20 places "les Grains de sable" located in Erdeven, 22 places "Ty ar Vugale" in Landévant

The Auray Quiberon Terre Atlantique Community of Communes wishes to grant, on an exclusive basis and at the concessionaire's expense and risk (transfer of operating risk), the management of the 4 aforementioned multi-purpose childcare centers, described in the Tender Documents (DCE). The public service concession agreement will be concluded for a duration of: - 5 years for the "Les Coccinelles" and "Ty Heol" multi-purpose childcare centers, - 4 years and 4 months for the "Ty ar Vugale" multi-purpose childcare center, - and 4 years and 3 months for the "Les Grains de sable" multi-purpose childcare center, starting from the date indicated in the notification letter after its transmission to the legality control. The provisional start date for the execution of the agreement is set for January 1, 2027. - The management of "Ty Heol" and "Les Coccinelles" will begin on January 1, 2027, - The management of "Ty ar Vugale" will begin on September 1, 2027, - The management of "Les Grains de sable" will begin on October 1, 2027. Between the contract notification date and the start date of the services, which vary from one facility to another, a preparation period is planned, detailed in Article 4 of the draft contract. Within the framework of this concession, the Concessionaire ensures the continuous management of the conceded service, under the conditions set by the contract, in compliance with the regulations concerning the management of early childhood reception facilities, the premises made available to them, and in complete technical and financial transparency. The Concessionaire is notably responsible for carrying out the following tasks: - organization and management of child reception, - overall personnel management, - financial management, collection of fees, particularly the single payment from the Family Allowance Fund for the general scheme, and special scheme funds, - invoicing and collection of family contributions, - reception of families, - meal service to children in compliance with food hygiene rules, - relations with external organizations, - establishment and application of an Operating Regulations, - establishment and monitoring of educational and pedagogical projects, - responsibility for the routine maintenance of buildings and the renewal of maintenance contracts, - responsibility for consumables, - responsibility for furniture, educational materials, and household appliances, for which they will ensure maintenance and renewal. In this arrangement, the Community of Communes: - remains the owner of the facilities, - ensures major maintenance work incumbent on the owner in accordance with the Civil Code, - retains oversight of place allocation through a commission. Clarification on the estimated value of the contract: In accordance with Article R3121-1 of the Public Procurement Code, the estimated value of the concession contract is 8,827,000 euros net of VAT. This estimated value was calculated using the following objective calculation method, in accordance with Article R3121-1 of the Public Procurement Code: it corresponds to the estimated total turnover excluding tax of the concessionaire during the contract duration, calculated based on the Grantor's experience with other multi-purpose childcare centers of similar capacity in its territory.
