En caso de que dos o más oferentes obtengan el mismo puntaje final en la Tabla de Evaluación de la Licitación, la adjudicación se resolverá aplicando el siguiente orden de prelación: en primer lugar, se priorizarán los criterios de la segunda etapa de evaluación, adjudicándose al oferente que obtenga el mayor puntaje en el criterio “Oferta Económica”; de mantenerse el empate, se considerará el mayor puntaje en el criterio “Sello Empresa Mujer” y, posteriormente, en “Prácticas Ambientales Sustentables”. Si la igualdad persiste, se recurrirá a los criterios de la primera etapa de evaluación, en el siguiente orden: “Experiencia”, “Mano de Obra”, “Programa(s) de Integridad y Compliance” y “Cumplimiento de Requisitos Formales”. En caso de subsistir el empate tras la aplicación de todos los criterios señalados, la licitación se adjudicará al oferente que haya ingresado primero su oferta en el Portal de Compras Públicas. Todo Oferente se obliga a no ofrecer ni conceder, ni intentar ofrecer o conceder, sobornos, regalos, premios, dádivas o pagos, cualquiera fuese su tipo, naturaleza y/o monto, a ningún funcionario público en relación con su Oferta, con el proceso de Licitación pública, ni con la ejecución del contrato que sederive de la misma, ni tampoco a ofrecerlas o concederlas a terceras personas que pudiesen influir directa o indirectamente en la adjudicación o ejecución del contrato. De esta forma, el Oferente tiene plena conciencia de que dichas prácticas constituyen delitos, cuya penalidad fue aumentada por la Ley N°21.121 que modifica el Código Penal y otras normas legales para la prevención, detección y persecución de la corrupción.
