Based on art. 24 of Law No. 14.133/2021, the estimated value of the contract may be kept confidential, provided it is duly justified, with the objective of avoiding compromise of negotiations and preserving the competitiveness of the bidding process. The adoption of a confidential budget presents several advantages, among which are: I – reduce information asymmetry between the Public Administration and bidders; II – encourage bidders to submit price proposals compatible with their actual costs, preventing values from being simply adjusted to the budget previously disclosed by the Administration; III – hinder the participation of companies without the necessary expertise, planning capacity, or technical responsibility for the adequate preparation of their proposals; IV – encourage bidders to present their best commercial conditions; V – foster negotiation between the Administration and bidders, when applicable; and VI – contribute to the selection of the most advantageous proposal for the Administration. Therefore, the estimated contract value will be kept confidential during the external phase of the procedure, remaining accessible to the competent administrative sectors and being made available to interested parties who formally request it, in accordance with applicable legislation. It is emphasized that the estimated budget will be part of the contracting process and may be made available to interested parties upon request. On the other hand, during the disclosure of the bidding instrument and related documents, the details of the quantities and other information necessary for the adequate preparation of proposals will be made public, especially those contained in the Terms of Reference. Thus, the confidentiality of the estimated budget seeks to preserve competitiveness, encourage more advantageous proposals, and facilitate eventual negotiation, without prejudice to transparency and access to information, in accordance with Law No. 14.133/2021.
