This contract is justified by the need to operationalize the granting of food cards to the employees of the Municipal Chamber of Jussara/PR, a benefit established by Municipal Law nº 1.882/2023 and updated by Municipal Law nº 2.011/2025.
Municipal Law nº 1.882/2023 authorized the Municipal Legislative Power to provide food cards to permanent and appointed employees of the Municipal Chamber, through the contracting of a company responsible for the administration, management, issuance, and supply of the benefit, in the form of an electronic card. The same law attributes an indemnifying nature to the benefit and establishes that it does not become part of the employees' remuneration.
Municipal Law nº 2.011/2025 amended the monthly value of the benefit to R$ 300.00, with retroactive effects from June 2025.
The electronic card solution offers greater administrative efficiency, control over the granting, operational security, credit traceability, and ease of use by employees, preserving the food purpose of the benefit.
The contract will cover 8 food cards, with a monthly individual credit of R$ 300.00, totaling R$ 2,400.00 monthly and R$ 28,800.00 annually in credits.
As a legal precaution and to avoid any economic mechanism incompatible with the food purpose of the benefit, the contract will prohibit negative administration fees, allowing for the lowest possible fee to be 0.00%. However, the previous contract, with negative fees, carried out by both the Executive and Legislative Powers, although conducted with all recommendations, resulted in a precarious contract. Federal Law nº 14.442/2022 prohibits discounts or advantages not linked to the promotion of food and health security in the provision of food assistance, and Prejulgado nº 34 of the TCE-PR addresses this matter in public contracts for food cards.
The bidding will be based on the criterion of the lowest non-negative administration fee, with the monthly credit of R$ 300.00 per beneficiary employee fully preserved.
In case of a tie in the lowest administration fee, including at 0.00%, a Proof of Concept will be conducted, exclusively as a tie-breaker criterion, using an objective matrix of 100 points previously defined in the Terms of Reference.
Finally, it is attested that the object is not part of the ordinary duties of the positions within the Municipal Chamber, as it requires a technological solution, a network of accredited providers, card issuance, and specialized management of the benefit.
