Purpose for access to Marriage data: so that this Institute can comply with Complementary Law No. 150 of 12/20/2023, as well as current legislation at the time of granting death pension benefits, access to marriage record information will serve as an instrument for verifying the continuity of payment of benefits granted by the Institute, in order to identify beneficiaries who have remarried. This information is necessary because state legislation provides for the loss of dependent status due to judicial separation or divorce without alimony; annulment of marriage, by emancipation or remarriage. Art. 12 of the aforementioned Complementary Law.
Access to marriage data is essential for the Institute to prevent fraud and undue payments, as it is the Institute's responsibility to administer, manage, and operate, including revenue collection and resource management, the granting, payment, and maintenance of social security benefits, with responsibilities defined by law, according to Art. 1, sole paragraph of Complementary Law No. 150 of 12/20/2023.
Purpose for access to death data: In order to also comply with Art. 12 of State Complementary Law No. 150 of 12/14/2023, in its item VI, which provides for the loss of dependent/beneficiary status due to death, access to death record information will serve as an instrument for verifying the continuity of payment of benefits granted by the Institute, in order to identify deceased beneficiaries, aiming to terminate the benefit, given that the annual proof of life does not allow the identification of deaths in a timely manner to avoid undue payments.
Access to marriage data is essential for the Institute to prevent fraud and undue payments, as it is the Institute's responsibility to administer, manage, and operate, including revenue collection and resource management, the granting, payment, and maintenance of social security benefits, with responsibilities defined by law, according to Art. 1, sole paragraph of Complementary Law No. 150 of 12/20/2023.
It is also necessary for payment control for social security compensation purposes, as the instituting regime must manually cease it in the Comprev system, to avoid receiving undue amounts and payment of offsets, Ordinance 1400 of May 27, 2024, art. 79 § 2º. Up to 30,000 consultations/month, considering that consultations based on the payroll will be necessary, we use the payroll report informing the following quantities: the quantity of 2,665 civil pensioners, of which 627 are child, stepchild, ward, and minor pensioners under guardianship aged 16 to 21 years – civil and military, 14,947 civil retirees, and 2,829 military inactive personnel.
