1. The Government of Sint Maarten (GoSXM) has received financing from the World Bank toward the cost of the Sint Maarten Wastewater Management Project and intends to apply part of the proceeds for consulting services under this request for expression of interest.
2. The Government of Sint Maarten (GoSXM), represented by the National Recovery Program Bureau (NRPB) is looking to select an experienced (international or national) firm for a consultancy service for the Review and to Enhance Legislative Framework regarding On-Site Sanitation and Develop Fecal Sludge Management Standards in Sint Maarten. The overall objective of this consultancy is to provide specialized technical expertise to develop two foundational, interlinked instruments for sustainable sanitation and wastewater management in Sint Maarten: a National Sanitation Strategy (NSS) including phased implementation plans for its expansion and for the overall wastewater management system, and a regulatory and operational framework for improved management of fecal sludge from septic tanks, including locally appropriate standards, licensing mechanisms, monitoring protocols, and proposed amendments to existing legislation where required to enable their implementation.
3. The consulting firm shall be responsible for delivering the outputs described below. It is imperative for the consulting firm to undertake a comprehensive review and provide actionable recommendations and documents detailed in the outputs below. The outputs expected from the assignment are:
· Technical note situational analysis - Comprehensive assessment of existing legislative and institutional framework, sanitation coverage, environmental and health conditions, and FSM practices. Include socio-economic and demographic assessment influencing sanitation service demand and affordability
· Draft National Sanitation Strategy & Implementation Plan - Complete draft of the NSS and its phased implementation plan, including proposed institutional roles, financing options, and considerations of harmonizing with other strategies and plans
· Draft FSM regulatory package - A consolidated package containing: Draft tariff methodology, phased tariff implementation plan; Draft standards for containment, collection, and transport; Draft licensing and monitoring framework for service providers, including proposed fee/sanction structures; A proposal for a sustainable FSM long term financing model
· Stakeholder consultation - Facilitate at least one validation workshop to present and receive feedback on the draft strategy and regulatory package from all relevant stakeholders (VROMI, private sector, civil society); Provide a summary of workshop outcomes and how feedback was
addressed
· Final National Sanitation Strategy and implementation plan - Final versions of the strategy and plan, incorporating feedback from stakeholders and the client
· Final FSM regulatory package and recommendations - Finalized standards and licensing framework, incorporating all feedback; Proposed amendments to existing legislation and regulations; Draft legal provisions where required; Draft a roadmap for legal adoption and implementation, and the financial framework.
4. The detailed scope and deliverables of the assignment are available in the Terms of Reference (TOR).
5. The National Recovery Program Bureau (NRPB) now invites eligible firms (“Consultant”) to indicate their interest in providing the Services. Interested Consultant should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. · At least 5 years of experience in providing similar sanitation policy and regulatory advisory services.
· Experience in Sanitation policy, strategy development, institutional reform, stakeholder engagement, financing models.
· Experience in Regulatory framework design, standards development, licensing schemes, enforcement mechanisms, legal drafting.
· Experience in Fecal sludge management (technical standards), environmental and health assessment, water quality, treatment technologies.
These would form the shortlisting criteria.
6. The selection process will be undertaken in line with the World Bank’s “Procurement Regulations for IPF Borrowers” Fourth Edition November 2020 (“Procurement Regulations”) for open competitive selection. A Consultant will be selected in accordance with the Quality and Cost-Based Selection (QCBS) method set out in the Procurement Regulations.
7. The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” (November 2020) (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.
8.
