Part I of the order – covering the collection and transport of waste from Sector I – the characteristics of the sector are included in the annex to the SWZ titled: "List of residential properties for Parts I-V"

1. Part I – covering the collection and transport of waste from Sector I – the characteristics of the sector are included in the annex to the SWZ titled: "List of residential properties for Parts I - V". 2. The detailed description of the subject of the order is contained in the annexes to the SWZ titled: "Description of the Subject of the Order for Parts I - V", "List of residential properties for Parts I - V", as well as the draft contract for Parts I - V. 3. Estimated quantities of waste to be collected and transported (in Mg) are specified in the table in point 1 of the "Offer Form for Part I; II, III; IV; V". The quantities of waste indicated in the Offer Forms are estimated quantities regarding total mass and the mass of individual types of waste, and the Contractor will settle with the Contracting Authority based on the actual mass of municipal waste collected and delivered to the municipal facility. 4. Waste collection and transport will be carried out in accordance with applicable legal regulations, in particular the Act of April 27, 2001, Environmental Protection Law, the Act of December 14, 2012, on Waste, the Act of September 13, 1996, on Maintaining Cleanliness in Municipalities, and the implementing regulations to these acts. 5. The Contracting Authority foresees the possibility of granting orders referred to in Art. 214 sec. 1 point 7 of the Public Procurement Law Act, with a net value for Part I not exceeding PLN 69,110.00 net. 6. The orders referred to in point 5 will consist of repeating similar services to those covered by the subject of the main order. These orders may be granted if it is beneficial for the Contracting Authority or if there is a need for their execution. Furthermore, these orders may be granted after securing appropriate financial resources to finance the order. These orders will be awarded using unit lump-sum prices applicable in the contract for the main order, and if this is not possible, under conditions negotiated by the Contracting Authority and the Contractor. 7. The Contracting Authority may exercise the option right under the following conditions and assumptions: 1) with a maximum value of up to PLN 725,658.00 net for Part I of the order; 2) the option right will consist of extending the implementation period of the concluded contract and the quantity of waste collected and transported from residents (in accordance with the concluded contract and SWZ) for a period during which the order can be implemented up to the amount indicated in point 1 (or lower, if the Contracting Authority exercises the option right to a lesser extent), taking into account the unit lump-sum price in the valid contract (at the time of exercising the option right), the provisions of the SWZ, annexes to the SWZ, and the provisions of the order contract apply to the option right and settlement will be as per the main contract; 3) the option right may also consist of increasing the scope of the order during the term of the contract (during its implementation period); 4) the option right is exercised by a unilateral declaration of will by the contracting authority, addressed to the contractor within the period before the expiry of the order contract and will apply in the event of the need to ensure the continuity of waste collection; 5) the contractor has no right to demand that the contracting authority exercise the option right or demand an increase or decrease in its scope; 6) the scope and extent of the option right are determined by the contracting authority.
