Part I of the order: MOSiR facility at ul. Hutnicza 15, 37-450 Stalowa Wola;

1. The subject of the order is the performance of cleaning services in the scope of comprehensive cleanliness maintenance in the facilities: sports and recreational, administrative, indoor and outdoor swimming pool for SiR Sp. z o.o. in Stalowa Wola, as well as snow removal and ice clearing around the entrances to these facilities, in an efficient, thorough, and timely manner, using devices, materials, and agents that do not damage the cleaned surfaces and equipment, in accordance with the Specification of Conditions of the Order and its attachments, which are an integral part of this agreement. 2. The subject of the order has been divided into two parts: - Part I of the order: MOSiR facility at ul. Hutnicza 15, 37-450 Stalowa Wola; - Part II of the order: PCPN facility at ul. Hutnicza 10A, 37-450 Stalowa Wola. 3. During the performance of services for Part I of the order, the contractor shall use chemical agents in accordance with Annex No. 2A – Detailed Description of the Subject of the Order and Annex No. 3 – List of proposed cleaning and disinfection agents for the swimming pool – Part I of the order. 4. The detailed scope of the order for Part I and Part II is specified in Annex No. 2A and 2B – Detailed Description of the Subject of the Order and graphic attachments to the SWZ. 5. The contracting authority does not require the Contractor to conduct a site visit or to inspect the documents necessary for the performance of the order on the premises of the contracting authority. 6. In accordance with art. 95 sec. 1 of the Pzp Act, the Contractor shall be obliged to: 1) Employ, by the Contractor or Subcontractor under an employment contract, persons performing activities related to the performance of the order, which consist of performing work in the manner specified in art. 22 of the Act of June 26, 1974 – Labor Code (consolidated text: Journal of Laws of 2022, item 1510, 1700, 2140, of 2023, item 240) the following activities: - Services related to building cleaning; The contracting authority requires that persons performing the activities mentioned above, within the employment relationship connecting them with the employer, perform them personally, at the place and time indicated by the employer, under their supervision, with subordinate reporting, for remuneration, with the right to vacation. 2) Provide the contracting authority on the day of commencement of the order with a list of persons who will perform the activities referred to in point 1) during the performance of the order. This list, in case of a change of person/persons performing the activities referred to in point 1), must be updated immediately each time. 3) If the contractor entrusts part of the order involving the performance of activities referred to in point 1) to a subcontractor, the obligation to employ persons performing these activities under an employment contract shall also apply to the subcontractor. 4) During the performance of the order, the contractor (subcontractor) shall, upon request of the contracting authority, present proof of employment of persons referred to in points 6.1-3 under an employment contract. 5) In case of failure by the contractor (subcontractor) to fulfill the obligations referred to in points 6.1-3, the contracting authority foresees sanctions in accordance with the draft contract attached to the SWZ. 6) The above requirement does not apply to the construction manager/site manager, as according to art. 12 of the Construction Law, activities involving the management of construction or other construction works may be performed by a person holding a technical function in construction. Technical functions in construction may only be performed by persons with construction licenses. Construction licenses are issued by name. Therefore, managing construction works does not require establishing an employment relationship under the supervision of an employer. The above requirement is not effective if the aforementioned activities are entrusted to natural persons conducting business activities, who will perform these activities personally based on a civil law relationship with the Contractor. 7.
