This procedure concerns the acquisition of AMR equipment, fully equipped with connectors and other accessories necessary for network installation and featuring its own monitoring application (gateway for communication with the contracting entity's application), along with installation services in the field, de-installation upon request, preventive maintenance services, corrective maintenance, and support for the hardware and software components of the AMR equipment, training services, and knowledge transfer to the contracting entity's technical team, and integration services into the contracting entity's AMR application, as detailed in the specifications. The minimum estimated quantities of the Framework Agreement, the maximum estimated quantities of the Framework Agreement, the minimum estimated quantities of the largest Subsequent Contract, as well as the maximum estimated quantities of the largest Subsequent Contract are found in the Specifications, Chapter XII. REVIEW CLAUSE IN ACCORDANCE WITH THE PROVISIONS OF ART. 236 of LAW no. 99/2016: Given that the tender documentation contains a minimum set of specific information, relating to estimates of minimum and maximum quantities that could be requested throughout the duration of the framework agreement, as well as estimates of minimum and maximum quantities that could be the subject of a single subsequent contract among those to be awarded during the framework agreement, we emphasize that these minimum and maximum quantities that the contracting entity initially establishes in the tender documentation and subsequently in the framework agreement represent estimates of quantities that could be requested throughout the entire framework agreement and not the exact quantities that will be purchased, the latter being potentially smaller, equal to, or larger than the estimated ones, depending on the actual needs of the contracting entity. In this regard, considering that the effects of the Framework Agreement primarily concern the establishment of the terms and conditions governing public procurement contracts (subsequent contracts) to be awarded within a certain period, particularly regarding the unit price and, where applicable, the quantities considered, the contracting entity informs bidders that it reserves the right/option to increase the estimated quantity at the level of the tender documentation / Framework Agreement by up to a maximum of 50% of the initially estimated maximum quantity. The price at which the related products and services can be additionally purchased under this review clause is the one from the financial proposal that forms the basis for signing the framework agreement to be awarded (adjusted price, where applicable, according to the adjustment formula provided by specific legislation). The period during which this option can be exercised by the contracting entity: throughout the validity period of the framework agreement. The modification of the framework agreement based on this review clause falls within the scope of non-substantial modification regulated by art. 240 para. (1), letter a) of Law no. 99/2016, having all the elements provided by art. 2 para. (1)-(2) of ANAP Instruction no. 1/2021. Considering the above review clause, the estimated value of the procedure was expressed as an interval, namely: Estimated value: 1,454,310 Euro, excluding VAT - 2,181,465 Euro, excluding VAT, where the MINIMUM VALUE OF THE INTERVAL (1,454,310 €) REPRESENTS THE ESTIMATED VALUE OF THIS PROCEDURE BASED ON WHICH THE OFFERS WILL BE EVALUATED, and the maximum value of the interval (2,181,465 €) represents the estimated value including the value of possible increases based on the review clause.
