List of activities to be carried out during the term of the framework agreement can be found in the specifications. Estimates of the minimum and maximum quantities that may be requested during the entire framework agreement and those that may be subject to a single contract among those to be awarded during the framework agreement can be found in the annexes to the specifications (character limits apply here). Modifications to the framework agreement/public procurement contract during its validity period may be made under the conditions provided for in art. 221 of Law no. 98/2016 and the provisions of ANAP Instructions. New types of products/services/works may be introduced during the framework agreement, based on art. 221 para. (1), letter f) of Law no. 98/2016 in conjunction with art. 9 of Instruction no. 1/2021, treated as low-value contractual modifications - adaptations to the practical context", which do not affect the general nature of the contract/framework agreement, which are related to the execution of the framework agreement (necessary for the efficient implementation of the respective contract from the perspective of the Contracting Authority and/or for improving the quality of its results), up to 10% of the value of the framework agreement. Unit prices in this case will be determined by reference to similar unit prices in the contract, with appropriate adjustments. If there are no similar unit prices for calculating the modification, the reasonableness of the price will be taken into account, considering any relevant aspect that reflects the nature of the product, the level of quality, the origin as the case may be, as well as any aspect that impacts the price, plus a reasonable profit. The reasonableness will be assessed in relation to generally accepted good practices in the respective sector of activity, so as to reflect that the procurement of the products/services/works that are the subject of the modification was carried out under conditions of economic and social efficiency, achieving the necessary quality level, at a price not exceeding the average market price in the relevant sector. During the validity period of the framework agreement, the Promising Purchaser reserves the right/option to increase the quantity of products/services/works estimated in the tender documentation by up to a maximum of 50% of the maximum quantity estimated for the framework agreement. The price of products/services/works that can be additionally purchased under this revision clause is that from the financial proposal on which the framework agreement is based (adjusted as appropriate according to the adjustment formula).
