(8) of Law no. 98/2016, as updated, the Contracting Authority reserves the right to apply the negotiation procedure without prior publication of a participation announcement in the situation where new works arise during execution, consisting of the repetition of similar works provided for in the initial contract. The value provided for these works is up to RON 3,441,631.42 excluding VAT. The maximum estimated value is RON 29,582,307.24 excluding VAT, composed of the minimum estimated value of RON 26,140,675.82 excluding VAT + the value related to additional works, according to art. 104 para. (8) of Law 98/2016, of RON 3,441,631.42 excluding VAT. This value is additional to the value that will be offered in the Price Schedule (financial proposal) and will be used by the contracting authority exclusively for the purchase of potential additional architectural and structural works, which will prove necessary for the completion of the investment objective and which were not the subject of the tender documentation (Technical Specifications, DALI, Technical Expertise, Specialized Studies) or the offer, being identified in the execution phase of the works after carrying out demolition, stripping, dismantling activities, etc. The settlement of additional works that will be the subject of the negotiation procedure without prior publication of a participation announcement will be carried out based on the quantities actually executed, established by site orders and confirmed by the site supervisor. The value of these works will be determined based on the following principles: a) similar and relevant elements from the Contract, if any; b) reasonable Cost estimates plus a reasonable profit; c) market prices.
