Default lot

The subject of the contract is the construction of an express road section approximately 10.83 km long, between the localities of Satu Mare (Satu Mare Bypass) and Oar (Csenger – Hungary), in accordance with the provisions of the works contract. In accordance with the contractual provisions, respectively HG no. 1/2018, any modifications that may occur during the contract period refer to the following, without being limited to these: 1. Changes to the contracting parties, including the replacement of the contractor with a new contractor under the conditions provided for in art. 221 para. (1) letter d), point (ii); 2. Changes generated by the increase or decrease of a quantity of works from the Bill of Quantities, when such an increase or decrease is the result of the measure provided for in Clause 49 [Measurement, Valuations and Provisional Sums]; 3. Changes generated by the increase or decrease of a quantity from the Bill of Quantities as a result of changes to the Specifications or Drawings; 4. Changes generated by the requests of utility network owners; 5. Changes to the expropriation corridor which lead to the need for additional works and/or the abandonment of existing works in the Contract; 6. Extension of the Execution Period based on the contractual mechanism provided for in Clause 35 [Extension of the Execution Period] of the General Conditions without prejudice to the Beneficiary's right to apply penalties and/or sanctions provided for in the contract to the Contractor; 7. Changes to the Technical Execution Project, resulting from the adaptation of the technical project to the reality on the ground, including changes to specific technical solutions; 8. Changes generated according to sub-clause 37.11 [Proposal for Modification initiated by the Contractor]; 9. Changes generated by modifications of the levels, positions and/or dimensions of certain categories of works/items of works as a result of the situation on the ground; 10. Changes generated by modifications of the terrain, above-ground and underground hydrographic network, unknown at the time of project development; 11. Legislative changes or changes to technical standards/standards/regulations/standards/, which will be carried out in accordance with the corresponding clause in the General Conditions of the Contract; 12. Changes generated by requirements of environmental authorities; 13. Changes generated by local/central authorities, requested through various opinions/approvals/authorizations; 14. Changes generated by the inclusion of new subcontractors/suppliers/subcontractors of subcontractors/any other economic operators and/or generated by the replacement of initial subcontractors/suppliers/subcontractors of subcontractors/any other economic operators, which will be carried out in accordance with the corresponding clause in the General Conditions of the Contract; 15. Changes generated by personnel changes, which will be carried out in accordance with the corresponding clause in the General Conditions of the Contract; 16. Changes generated by technical expertise; 17. Changes generated by requirements regarding research and archaeological works; 18. Changes resulting from the implementation of requests from various institutions/authorities/entities that have responsibilities related to the investment objective (e.g.: Ministries, JASPERS, central and/or local Authorities/Institutions, certified Verifiers, control bodies, etc.). 19. Changes to the contract value as a result of the above changes, respecting the provisions of Law no. 98/2016. The changes will be made after the signing of the contract, in accordance with the contractual provisions, only if they do not constitute substantial modifications in the sense of the provisions of art. 221 para. (7) of Law no. 98/2016, as amended and supplemented. More information can be found in the Contract.
