According to the terms of reference no. 18480/22.04.2024. The Beneficiary's requirements specify the purpose, coverage area, design requirements, as well as other technical criteria regarding the Works. The design and execution of the Works by the Contractor shall comply with the Beneficiary's Requirements. Except where otherwise specified, all materials, equipment, machinery, execution, and design must comply with: i. The Urbanism Certificate for these Works, as well as other specific requirements from all permits/approvals to be obtained; ii. The Environmental Permit for these Works; iii. The list of Romanian standards, norms, and codes, as well as current foreign and European norms, in accordance with the provisions of these contractual documents. In the event that the Contractor is required, under the "Beneficiary's Requirements", to obtain approvals from an institution, these approvals shall not limit the Contractor's Obligations under the Contract, and in the event that any errors, omissions, ambiguities, inconsistencies, incoherencies are found in the Contractor's documents, these, as well as the executed works, shall be corrected at the Contractor's expense, without requesting additional costs from the Beneficiary. Information regarding the joint offer (association, if any) Any economic operator has the right to participate in the award procedure as a bidder or candidate, individually or jointly with other economic operators, including in temporary association forms established for the purpose of participating in the award procedure, under the conditions provided by Law 99/2016 on sectoral procurement. In the case of submitting a joint offer, each economic operator member of the association will submit the ESPD, in which they will include information on how the economic and financial capacity and/or technical and professional capacity requirements are met, proportionally to their involvement in the execution of the future contract, as well as the association agreement, according to Form no. 2, accompanied by information about the association Annex to the Form. The supporting documents proving what has been undertaken by the association agreement will be presented by the bidder ranked first after applying the award criterion, before the contract award. The associates shall be jointly and severally liable for the execution of the contract in accordance with its terms. The leader of the association is responsible in its own name and on behalf of the Association for the fulfillment of the contract. Contracts concluded between the leader of the association and associates/subcontractors will become annexes to the contract concluded between the contracting entity and it. Information regarding the third party/parties supporting (if any) The bidder is obliged to provide information regarding third-party support. The bidder will complete the ESPD with information regarding the existence of third-party support, including the measures taken by it to access the necessary resources at any time, to which the ESPD and the firm commitments of the third-party supporter/supporters are attached, from which the effective way in which the third-party supporter/supporters will ensure the fulfillment of the commitment must be evident, according to Form no. 4, accompanied by the documents requested by the Commitment, Annexes to the Form. • The bidder will present, along with the ESPD, the Commitment of support accompanied by documents, which will constitute annexes to the respective commitment, showing the effective way by which the third-party supporter will ensure the fulfillment of its commitment. Note: For the purpose of verifying the fulfillment of the qualification requirements, the contracting entity may request from the third-party supporter, at any time during the evaluation process, additional documents and information related to the given commitment or the submitted documents (art. 56 of HG 394/2016).
