The framework agreement has as its object the provision of a repetitive and continuous catering service, where the daily quantity depends on the actual presence of beneficiaries, school days, and available funding. For this reason, the use of a framework agreement allows for the prior establishment of technical, financial, and contractual conditions, with the subsequent awarding of sub-contracts without resuming competition, within the published quantitative and value limits. The food package offered will consist each day of a sandwich plus a fruit of choice. The sandwich will be made up of bakery products, protein components – meat products and/or cheeses/dairy derivatives – and vegetables, in the proportions and weights established by the technical requirements of the documentation and by the applicable PNMS norms. The fruit will be whole, fresh, healthy, clean, without signs of spoilage, and suitable for immediate consumption. The type of food support remains unchanged for the duration of the sub-contracts, respecting the applicable regulatory framework. The tenderer will present in the technical proposal an example menu for a minimum of 7 school days, distinct for each day, indicating the composition of the sandwich, ingredients, weights, allergens, and nutritional values, as well as the fruit offered. Each daily menu will include a sandwich plus a fruit of choice. The menus will demonstrate dietary diversification and compliance with nutritional and technical requirements, without diminishing the quality or minimum weights requested. The economic operator will apply a documented food safety system based on HACCP principles, will ensure the traceability of raw materials and products used, and will be able to identify, for each batch and delivery day, the suppliers, raw material batches, preparation and packaging date, persons and flows involved, and delivery points. The label and documents accompanying the delivery will include mandatory information regarding the product, ingredients, allergens, preparation/packaging date, shelf life, and storage conditions, in accordance with applicable legislation. The provider will ensure authorized/registered transport means for the activity carried out, which are clean, sanitized, and suitable for food transport. Transport will be organized on routes so that products are protected against contamination, deterioration, and improper exposure. Resources may be owned or secured through leasing, rental, loan, or other legal forms that confer a certain right of use for the duration of the service. In case of non-conformity found upon receipt, the provider will be obliged to replace the non-conforming packages within the timeframe assumed in the offer, at no additional cost to the contracting authority. The minimum technical requirement for remediation is a maximum of 40 minutes from the notification of non-conformity and, in any case, before distribution to beneficiaries. The offered time becomes a firm contractual obligation. The provider will maintain a microbiological self-control system and will carry out analyses in authorized/accredited laboratories, in accordance with applicable legislation and the level assumed in the offer. Non-conforming results will lead to the immediate application of corrective measures, identification of affected batches, and, where applicable, withdrawal/replacement of products. Waste management and prevention of food waste are technical and contractual obligations. The provider will apply measures to reduce waste resulting from packaging and distribution and will manage waste in accordance with legislation, without these minimum obligations constituting evaluation factors in themselves.
