Suspensive clause The conclusion of the public procurement contract is conditional upon obtaining/approving the financing for the procurement of products from the state budget and/or other sources, excluding non-reimbursable funds and PNRR. The signing of the contract will only be possible if the provisions regarding the commitment of expenses from budgets falling under the scope of public finance legislation are respected. In the event that, for any reason, obtaining/approving the financing for the procurement of products from the state budget and/or other sources, excluding non-reimbursable funds and PNRR, is not possible, the NATIONAL UNIVERSITY OF SCIENCE AND TECHNOLOGY POLITEHNICA BUCHAREST will apply the provisions of art. 212 paragraph (1) letter c) second part of Law 98/2016, making it impossible to conclude the public procurement contract. The suspensive clause operates for a period of 6 months from the date the winner is declared. The offer validity period is 6 months. In the event that, for any reason, the financing contract is not signed or funds from the state budget cannot be approved in accordance with the mentions in this section, the National University of Science and Technology POLITEHNICA Bucharest reserves the right to apply the provisions of art. 212 paragraph (1) letter c) of Law 98/2016, as updated. Bidders in this procedure accept that the National University of Science and Technology POLITEHNICA Bucharest and/or the financier cannot be held liable for any damages in case of cancellation of the award procedure, regardless of its nature and regardless of whether the contracting authority and/or the financier have been notified of the existence of such damage.
