The subject of this Service Contract is the provision of high-quality supervision services, both during the execution period of the works and during the warranty period of the works, in order to monitor the correct use of available funds and to ensure that the Contractor executes the works in accordance with the contractual obligations, particularly regarding the duration, quantity, quality, and cost of the works. The Supervisor shall have the role of Supervisor in accordance with the provisions of the Conditions of the Contract for the Execution of Works for the Craiova – Pitesti Express Road Section 1 km 0+000 – km 17+700 – Re-tender, and the General and Specific Conditions for certain categories of procurement contracts related to investment objectives financed by public funds, approved by Government Decision no. 1/10.01.2018 with subsequent amendments and additions. In accordance with the provisions of art. 221 of Law 98/2016, with subsequent amendments and additions, and respecting article 24 of the Service Contract, any modifications that may occur during the contract period refer to the following, without being limited to these: 1. Changes in the contracting parties; 2. Changes resulting from the need for additional studies/expert assessments; 3. Changes resulting from the implementation of requests from various institutions/authorities/entities that have responsibilities related to the investment objective (such as: Ministries, JASPERS, central and/or local authorities/institutions, certified verifiers, control bodies, etc.); 4. Legislative changes or changes in technical standards/state standards/regulations/standards during the contract period; 5. Changes generated by the inclusion/introduction of new subcontractors and/or replacement of initial subcontractors; 6. Changes generated by the change/replacement of key/non-key personnel (other than the experts/persons who were scored in the evaluation criteria related to the award criterion); 7. Changes regarding the extension of deadlines for the Provider to submit reports/deliverables specified in the contract or changes related to the verification and approval of reports/deliverables by the Beneficiary 8. Modification of the initial Gantt Activity Schedule within the Contract during the Service Provision Period by reallocating personnel and/or existing resources/savings. 9. Reallocation of resources or savings within the service contract resulting from: a) non-consumption of working days due to non-mobilization/demobilization/reduced mobilization of experts/personnel; b) the probability that certain resources will no longer be consumed/needed; c) the application of the provisions of art. 20.9 of the Service Contract; d) non-consumption of working days due to the delayed signing of the service contract compared to the execution contract (in cases where certain stages of the execution contract have already been completed); e) redistribution of working days among experts/persons and/or among contract stages/phases for the purpose of correlating supervision services with the duration/phase/stage/evolution/physical status/physical progress of the works execution contract; 10. Extension of the Service Provision Period based on the modifications mentioned in the points above, as well as in the following situations: a) extension of the duration of works execution and/or the warranty period of the works; b) the need to correlate the service provision period with the duration/phase/stage/evolution/physical status/physical progress of the works execution contract; c) delay in works execution due to difficulties encountered by the Contractor; d) suspension/termination of the execution contract; e) appearance of regulations/dispositions from the Traffic Police after the signing of the execution contract; f) appearance of works...
