The works for the objective "Repair of railway line 400 Topliţa – Stânceni (from Km. 183+954 to Km. 192+945) including lines 2, III, 4 and turnouts no. 1, 3, 9, 5/7, 2, 8, 14 and 4/6 in Topliţa station (execution)" are to be carried out according to the PTH+DE, Specifications and Quantity Lists. Contract duration: 17 months, respectively 521 days, to which, if applicable, a maximum of 4 calendar months per calendar year is added, for the interruption of works during cold weather, in the conventional period November 15 - March 15. The estimated value does not include provisioned amounts/implementation reserves. NOTE: The estimated value does not include the value of miscellaneous and unforeseen expenses. The value of miscellaneous and unforeseen expenses (calculated at 15% of the value of C+M expenses in the contract) is not included in the total contract value; it represents expenses included in the cost structure of the investment object, according to HG 907/2016. The use of amounts related to these is made according to needs, for unforeseen situations that may arise during the execution of the works, situations that could not be taken into account when preparing the project, by concluding an additional act to the initial contract (according to art. 235-241 of Law 99/2016). SUSPENSIVE CLAUSE: The award procedure is carried out under this suspensive clause, meaning that the signing of the works execution contract will only take place after the financing source has been secured. The conclusion of the contract with the economic operator who will be declared the winner after the completion of the sectoral procurement procedure, for the execution of the works related to this objective, is conditional upon obtaining/approving the financing of the works, the signing of the contract being possible only if the provisions regarding the commitment of expenses from budgets subject to public finance legislation are respected. If, for any reason, the obtaining/approval of financing for the works from the state budget is not achieved, after receiving notification from the competent authorities regarding the non-granting of financing, the contracting entity reserves the right to apply the provisions of art. 225 para (1) letter c) of Law 99/2016 updated: "if violations of legal provisions affect the award procedure or if it is impossible to conclude the contract". Offerors participating in this procedure understand that the contracting entity and/or the Ministry of Transport and Infrastructure and any other functional structure involved in the implementation of this project and/or the Government of Romania, cannot be held liable for any damage, regardless of its nature, in case of cancellation of the award procedure/non-signing of the works contract within the proposed deadline, and agree to the use of the special conditions stated - suspensive clause -, assuming full responsibility regarding any damages they may suffer in the described situation. The period during which the suspensive clause applies is estimated to be 10 months from the approval of the procedure report. The Contracting Entity estimates that it is possible to obtain the necessary financing for signing the contract during 2025. Considering this, offerors will take into account the extension of the offer validity and participation guarantee, at the request of the contracting entity, until the conclusion of the works contract.
