The framework agreement/subsequent contracts may also be amended as a result of correcting material errors contained therein, if ascertained by any of the contracting parties. The categories of amendments provided for in points 1 and 2 will not affect the general nature of the framework agreement/subsequent contracts. In the event that, during the execution of the framework agreement/subsequent contracts, the need for another amendment arises, the contracting authority will determine, before approving and formalizing the respective amendment, whether it represents a non-substantial amendment without the need to organize a new procedure or a substantial amendment that would require the organization of a new award procedure. During the validity period of the framework agreement, the parties have the right to agree to amend and/or supplement its clauses within the limits of the provisions of the applicable legal acts in the field of public procurement. The framework agreement may be amended only with the written consent of both parties, through an additional act. The party requesting the amendment of the framework agreement will be obliged to notify the other party in writing within a maximum of 5 working days from the date on which the situation that may lead to its amendment occurred. The amendment of the framework agreement will not concern the revision of the unit prices offered through the technical-financial proposal, the unit prices remaining firm for the entire validity period of the framework agreement. Amendments that may occur to the clauses of a contract awarded in execution of this framework agreement cannot in any case bring substantial modifications to the terms and conditions initially established by it. The amendment of the framework agreement and implicitly of the subsequent contracts otherwise than in the cases provided for in art. 221 of Law 98/2016 is carried out by organizing a new award procedure, in accordance with the provisions of the law.
