The framework agreement concerns the modernization, maintenance, and repair of streets within the City of Zarnesti, including the execution of various current or emergency repairs that may arise during the four years of the framework agreement. Consideration was given to: - the multitude and diversity of works to be carried out - the need for services to be provided throughout the duration of the framework agreement. - ensuring the necessary qualified personnel on a permanent basis to fulfill contractual obligations. - ensuring the necessary funds for carrying out the mentioned activities are foreseen and approved annually in the budget of the municipality of Brasov. - the works that are the subject of the framework agreement and are to be carried out are permanent in nature, and by concluding a framework agreement, the Contracting Authority has the possibility to conclude subsequent contracts based on necessity. In accordance with art. 115, paragraphs (1) and (2), letter a) of Law no. 98/2016 on public procurement, the contracting authority establishes the award of the framework agreement, for a validity period of 4 years, to a maximum of 3 economic operators who meet all the requirements of the procurement documentation, for the following reasons: a) the execution of the works that are the subject of the framework agreement involves high complexity generated by the diversity of activities and the multitude of operations to be performed, differentiated labor for work categories, as well as the use of various materials; b) the execution of the works that are the subject of the framework agreement is required throughout the year, and the subsequent contracts to be awarded will have the same purpose and nature as the framework agreement. c) the subject of the framework agreement requires the contractor to ensure permanent qualified personnel in order to fulfill contractual obligations; d) the street maintenance works planned to be carried out for the fulfillment of the framework agreement's objective involve a stable and adequate repetitiveness, a repetitiveness necessary for the safe maintenance of public roads in the City of Zarnesti;
