II.1.4) Brief description - conclusion of a framework agreement for products for the procurement of “Products necessary for the integration into Smart Metering Systems of prosumer metering points” - in accordance with the specifications in the CS, respecting all parameters included in the attached technical data sheets Estimated total value – minimum 417,000.00 lei excluding VAT and maximum 20,850,000.00 lei excluding VAT Minimum estimated quantity AC: 500 units (single-phase meter) and 500 units (three-phase meter); Maximum estimated quantity AC: 25,000 (single-phase meter) and 25,000 (three-phase meter) Value of the largest subsequent contract: 10,500,000.00 lei Maximum estimated quantity of the largest subsequent contract CS: 12,500 units (single-phase meter) and 12,500 units (three-phase meter); Estimated schedule for awarding subsequent contracts: will be awarded according to emerging needs. The first subsequent contract will be awarded after the framework agreement is concluded. Minimum and maximum number of estimated CS to be concluded: minimum 2 and maximum 4, Frequency of subsequent contracts: minimum 2 and maximum 4, for the entire duration of the AC DELIVERY TERM of CS: in installments, according to art. 3.3.1 of the Technical Specifications The framework agreement will be signed with a minimum of 1 and a maximum of 3 economic operators. According to model AC 11.5. (1) For the signing of subsequent contracts, the Promising Contracting Entity will always address the Promising Supplier with the lowest price who is party to the Framework Agreement. (2) If Promising Supplier 1 does not sign the subsequent contract within the period provided for in art. 11.4 (1), the Promising Contracting Entity will address Promising Supplier 2. If Promising Supplier 2 does not sign the subsequent contract within the period provided for in art. 11.4 (1), the Promising Contracting Entity will address Promising Supplier 3. (3) If neither Promising Supplier 3 signs the subsequent contract within the period provided for in art. 11.4 (1), the framework agreement is terminated under art. 16.8.(1), letter d). Art. 11.4. (1) The Promising Supplier is obliged to sign the subsequent contract within a maximum of 5 working days from the date of receipt. Art. 16.8.(1) Termination of the Framework Agreement occurs, without prior notice by the Promising Contracting Entity as a result of: in the event that all Promising Suppliers refuse to sign the same subsequent contract.
