Digiraati.fi Web Service Modification of the procurement contract essentially during the contract period is prohibited. Essential contract modifications require the fulfillment of one or more grounds referred to in Section 136, Paragraph 2 of the Act on Public Procurement and Concession Contracts (1397/2016, hereinafter the "Procurement Act"). According to Section 2 of the provision, a modification is permissible if it is necessary for the original contractor to perform additional work or services or additional supplies that were not included in the original contract, and if it is not possible to change the contractor for economic or technical reasons and would cause significant harm or significant overlap of costs for the contracting entity. An additional condition is that the value of the modification referred to herein shall not exceed 50 percent of the value of the original contract. If several such modifications are made consecutively, each modification shall be assessed independently.

A cloud-based operating service has become a necessary way to organize operating services in the most cost-effective manner during the contract period. The operating service is procured in accordance with the original contract from the contracting entity's other suppliers, but the modification requires certain additional orders and responsibilities for the application supplier. It is not technically sensible to carry out additional work with another contractor, and it is not cost-effective for the contracting entity to postpone the implementation of the cloud-based operating service until the transfer and subsequent maintenance and development services have been procured and transitioned to the supplier selected in the procurement. Such a procedure would cause the contracting entity considerably greater economic harm than could be achieved through procurement. The modification is minor in nature and the annual value of the work to be ordered as an additional procurement is estimated at €21,600. The contracting entity ensures that the value of the additional procurement does not exceed the limits referred to in Section 136, Paragraph 3 of the Procurement Act during the remaining contract period.

The additional orders to be procured will be procured from the expert roles specified in the original contract and at their respective prices. Updated responsibilities of the contract will be agreed upon with updated responsibility distribution appendices. Thus, the cloud transition does not change the general nature of the contract either. The additional procurement can therefore be justified on the grounds referred to in Section 136, Paragraph 2, Point 2 of the Procurement Act.,
