In case of a tie, the mechanism to resolve it will consist of resolving in favor of the one who obtains the highest score in the evaluation criterion with the highest weighting. If the tie situation persists, the evaluation criterion that follows it, according to its weighting, must be considered. If the tie persists, Article 55, paragraph 5 of Decree No. 661 will be resorted to. In the event that the tie is maintained, the date and time of submission of the offer, registered in the offer reception act, will be considered as a tie-breaking criterion, with the first one being selected. If deemed necessary, and without prejudice to what is stated in these Tender Documents, the Academy may request clarifications from a proponent regarding aspects of their proposal that are not sufficiently clear. The clarifications requested by the Academy may not refer to essential elements or affect the equal treatment of bidders or the principle of adherence to the Tender Documents. Both the requested clarifications and the responses will become an integral part of the contracting documents and the Tender Documents, in case of award, which must be uploaded to the www.mercadopublico.cl portal. The contracting entity may request bidders to correct formal errors or omissions, to the extent that the rectification of such defects or omissions does not grant those bidders a privileged position with respect to the other competitors, i.e., as long as the principles of strict adherence to the Tender Documents and equality of bidders are not affected, and the rest of the bidders are informed of such a request through the information system. Likewise, the contracting entity may allow the submission of certifications or background information that the bidder(s) have omitted to submit at the time of making the offer, provided that such certifications or background information have been produced or obtained prior to the deadline for submitting offers or refer to situations that are not mutable between the deadline for submitting offers and the evaluation period, assigning a lower score in the formal requirements compliance evaluation criterion to offers that did not comply with all requirements within the deadline for submitting offers. For the correction of these errors or omissions, suppliers will have a period of 2 (two) calendar days, counted from the request, which will be informed through the system.
