1. The subject of the order is the supply of four low-temperature freezers for IHAR-PIB. 2. The contracting authority has not divided the order into parts and therefore does not allow the submission of partial offers. Justification: Dividing the order into parts is not justified due to the occurrence of technical and integration risks, in particular the risk of incompatibility of individual equipment components, dispersion of service responsibility, increased logistical costs, and organizational difficulties. The subject of the order constitutes a functionally integrated whole. Furthermore, due to the principle of rational expenditure of funds by the Contracting Authority, dividing the order into parts is not purposeful. At the same time, the order in its entirety is adapted to the needs of small and medium-sized enterprises within the meaning of Annex I to Commission Regulation (EU) No. 651/2014 of June 17, 2014. 5. In cases where indications of trademarks, patents, or origin appear in the description of the subject of the order, it should be understood in accordance with art. 99 sec. 5-6 of the Public Procurement Law that this is justified by the specificity of the subject of the order and the Contracting Authority cannot describe the subject of the order using sufficiently precise terms. In such circumstances, the Contracting Authority allows the submission of equivalent solutions in the offer, indicating that the minimum requirements that equivalent solutions must meet are requirements (functionalities) no worse than the parameters (functionalities) indicated in the Description of the subject of the order. 7. The contractor who refers to solutions equivalent to those described by the Contracting Authority is obliged to indicate in the offer which offer items contain equivalent solutions along with their description or norms and to demonstrate that the equivalent solutions offered by him meet the requirements specified by the Contracting Authority, in particular by means of objective evidence. 8. The Contracting Authority does not allow the submission of variant offers. 9. The Contracting Authority does not foresee the conclusion of a framework agreement. 10.
