The contracting authority informs that: 1) The contractor is obliged to offer a unit price for individual tariffs; 2) Sales will take place through the distribution network belonging to the Distribution System Operator (DSO), i.e., PGE Dystrybucja S.A., under the conditions specified by the Act of April 10, 1997, on Energy Law (consolidated text: Journal of Laws of 2024, item 266), hereinafter referred to as the "Energy Law", in accordance with the regulations applicable to the aforementioned act, provisions of the Civil Code, principles specified in concessions, terms of the SWZ, and in accordance with the energy price tariff presented in the tender offer, with which the contractor has concluded an agreement for the provision of distribution services in the areas where the electricity supply point is located; 3) Annex No. 1A to the SWZ indicates the Partners and provides data regarding the agreements held by the Partners. 4) The sale of electricity will take place under the conditions specified by the aforementioned Energy Law and in accordance with the implementing regulations issued for this act, in particular with the partner service standards specified in the Regulation of the Minister of Climate and Environment of November 29, 2022, on the method of shaping and calculating tariffs and the method of settlement in electricity trading (Journal of Laws of 2022, item 2505). 5) Settlements for the delivered electricity will be made based on invoices issued by the contractor separately for specific Partners (indicated in Chapter I), within the deadlines applied by the DSO, at prices included in the offer. 6) Payment deadline for the contractor: a) 30 days for Partners who are not medical entities (hospitals) b) 60 days for Partners who are medical entities (hospitals). 3. The contractor calculates the offer price in Appendix No. 1A to the SWZ – "Price Form", which must include all costs related to the performance of the contract. The document, filled out in accordance with the contracting authority's requirements and signed by the contractor, will be an attachment to the offer submitted by the contractor. 4. Detailed rules defining the method of order execution and settlements are included in Appendix No. 5 to the SWZ - Draft contract provisions.
