Auto-translated from Polish1) The subject of the order is the supply of electricity along with balancing services for the facilities of the Małopolska Police units. The order will be carried out under the conditions specified by the Act of April 10, 1997, the Energy Law, and its implementing regulations. The quality parameters of electricity are regulated by the Energy Law and its implementing acts (in particular, the Regulation of the Minister of Climate and Environment of March 22, 2023, on the detailed conditions for the functioning of the energy system and the current Operating and Exploitation Instructions of the Distribution System Operator (DSO)). 2) Electricity supplies will be provided to the facilities listed in Annexes No. 3 and No. 3a (option right) to the SWZ. The annexes to the SWZ specify, among others, the name and address of the facilities to which electricity will be supplied, the PPE identification number, tariff group, contracted capacity, and projected energy consumption over a 24-month period. 3) The total projected volume – over a 24-month period – is 21,078,834.00 kWh to 132 points of consumption (PPE) in the basic version and 25,500.00 kWh to 7 PPE in the option right. 4) The projected electricity consumption indicated above is indicative and may differ from the actual amount consumed during the contract period. 5) A reduction in the amount of energy will not entail any consequences for the Ordering Party, apart from the obligation to pay for the actually consumed amount of energy. 6) An increase in electricity consumption beyond the projected amount will require an amendment to the contract. 7) The projected quantities given in the table in Annex No. 2 to the SWZ are projected values. These values are indicated solely for the purpose of selecting the most advantageous offer by the Ordering Party and do not constitute an obligation of the Ordering Party towards the Contractor. The Ordering Party guarantees the execution of the contract at a minimum level of 70% of the estimated consumption. 8) Required contract execution period: continuous execution for a period of 24 months starting from the date agreed between the parties and specified in the concluded contract. The projected date from which the newly concluded contracts will be effective is: July 1, 2026. 9) Electricity will be supplied to the delivery points specified in Annexes No. 3 and No. 3a (option right) to the SWZ. 10) Settlement periods result from the Tariff for Distribution Services, subject to the provisions contained in Annex No. 5 to the SWZ – “Provisions significant for the parties, which will be introduced into the public procurement contract”. The Ordering Party does not agree to receive preliminary invoices based on projected electricity consumption. 11) Details regarding the tariff group, estimated energy consumption over 24 months, and contracted capacity for individual points of consumption are specified in Annexes No. 3 and No. 3a to the SWZ. 12) The Contractor, based on the granted power of attorney, will be obliged to: a) Conduct the supplier change procedure in accordance with currently applicable regulations, b) Represent the Ordering Party before the DSO in the supplier change process. 13) Data regarding current electricity suppliers for individual delivery points are specified in Annexes No. 3 and No. 3a to the SWZ. 14) For most PPE, the Distribution System Operator is Tauron Dystrybucja S.A. Exceptions are PPE in KPP Miechów and its subordinate units, i.e., PP Racławice, PP Książ Wielki, and PP Biecz, where the operator is PGE Dystrybucja S.A., and PPE in KMP Tarnów and KP Tarnów – Zachód, where the distributor is Grupa Azoty S.A. 15) The condition for commencing supplies by the date specified by the Ordering Party is the effective termination of existing contracts and the successful completion of the supplier change procedure. 16) Electricity purchased under the contract will be consumed for the needs of the Ordering Party (end consumer), which means that the Ordering Party is not an energy company in the sense...
