Delivery of factory new type C sanitary ambulances (bariatric) with a gross vehicle weight exceeding 3.5t with equipment for WSPR SPZOZ in Łomża

2. The subject of the order is the delivery of factory new (production year 2025), unused, not demonstration vehicles, type C sanitary ambulances with a gross vehicle weight exceeding 3.5t with equipment for WSPR SPZOZ in Łomża. The order includes the delivery of 2 vehicles. 3. The Ordering Party, within the scope of the order, foresees a quantity option, which consists of the additional delivery of an ambulance identical to that described in sec. 1, in the number of 1 unit. The conditions defining the type and maximum value of the option, as well as the circumstances of exercising the option, are included in the draft provisions of the Agreement, which constitute Annex No. 3 to the SWZ. 4. Detailed technical requirements for the base vehicles, as well as the medical compartment (medical bodywork) and the equipment of the ambulances, which are the subject of the order, both basic and covered by the option right, are specified in Annex No. 2 to the SWZ. The method of performing the subject of the order is described in detail in Annex No. 3 to the SWZ. 5. The subject of the order must be free from any physical and legal defects, approved for circulation based on applicable legal provisions, in particular, it must meet the requirements of current Polish Standards PN-EN 1789 and PN-EN 1865 or equivalent standards, because according to Article 36(2) of the Act of September 8, 2006, on the National Medical Rescue (Journal of Laws of 2025, item 91, as amended), a specialized sanitary transport vehicle (ambulance) must meet the technical and quality characteristics specified in Polish Standards transposing harmonized European standards. Furthermore, each type C sanitary ambulance complies with the technical parameters described in Annex No. 2 to the SWZ, and also has the necessary homologations for the base vehicle and the fully equipped sanitary ambulance. Each ambulance also complies with the provisions of the Act of May 20, 2010, on Medical Devices (Journal of Laws of 2024, item 1620, as amended), the Regulation of the Minister of Infrastructure of December 31, 2002, on the technical conditions of vehicles and the scope of their necessary equipment (Journal of Laws of 2024, item 502, as amended), the Act of June 20, 1997, Road Traffic Law (Journal of Laws of 2024, item 1251, as amended). 6. If the description of the subject of the order contains any trademarks, patents, or origin of source or a specific process that characterizes the products supplied by a particular Contractor – it should be assumed that the Ordering Party has provided a description indicating the type and allows for the submission of equivalent offers with technical, operational, and utility parameters no worse than those provided in the description of the subject of the order (legal basis – Article 99(5) of the Act). 7. If the description of the subject of the order contains standards, technical assessments, technical specifications, or technical reference systems referred to in Article 101(1)(2) and (3) of the Act, this should be treated solely as an aid in describing the subject of the order. In all cases, equivalent solutions are permitted. The Ordering Party will not reject an offer for non-compliance with the aforementioned standards, technical assessments, technical specifications, and technical reference systems referred to in Article 101(1)(2) and (3) of the Act, provided that the Contractor proves in the offer, in particular by means of subject-specific evidence, that the proposed solutions equally meet the requirements specified in the description of the subject of the order (legal basis – Article 101(5) of the Act).
