A detailed description of the subject of the order concerning all elements included in the Subject of the order is included in Annex No. 1 to the SWZ – OPZ. 1 The public procurement procedure is conducted in the form of an open tender, based on the Act of September 11, 2019 – Public Procurement Law (Journal of Laws of 2024, item 1320 as amended) [hereinafter also referred to as "Pzp"]. 2 The Contracting Authority will apply the procedure referred to in art. 139 sec. 1 Pzp (i.e., the so-called reverse procedure). 3.3 Due to the application of the procedure referred to in art. 139 sec. 1 Pzp, the Contracting Authority does not require the submission of a declaration along with the offer, referred to in Chapter X, point 12.2 of the SWZ. The Contracting Authority will request the submission of this declaration only from the Contractor whose offer has been assessed highest. 4 If there are grounds for exclusion against the Contractor whose offer has been assessed highest, this Contractor does not meet the conditions for participation in the procedure, does not submit subject-specific evidence or a declaration referred to in Chapter XII, point 12.2 of the SWZ, confirming the absence of grounds for exclusion or meeting the conditions for participation in the procedure, the Contracting Authority will re-examine and evaluate the offers of the remaining Contractors, and then carry out a subjective qualification of the Contractor whose offer has been assessed highest, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 5 The Contracting Authority continues the procedure referred to in point 4 until the selection of the most advantageous offer or the annulment of the procurement procedure. 6 The Contracting Authority does not allow partial offers.
