Delivery of brand new low-floor electric buses

Based on the procedure, under the conditions specified therein, the Contractor undertakes to: (1) deliver to the Contracting Authority 4 (in words: four) units of M3 Class II buses, with a length of 09.00 to 12.5 m, with electric drive. A detailed description, equipment, appearance and parameters of the vehicles have been established in the SWZ and in the Offer (hereinafter: "Buses"), (2) along with the delivery, hand over a full spare parts catalog for the Buses (in paper form and on electronic media), (3) conduct training for the Contracting Authority's employees responsible for servicing the Buses, and as a result, grant authorization for warranty repairs of the Buses (hereinafter: "Service Training") and conduct training for the Contracting Authority's employees responsible for driving the Buses (hereinafter: "User Training"), the detailed description, scope, conditions of the place of conduct and duration of which the Parties have specified in the SWZ; (4) deliver and install two dual-output mobile charging stations for electric buses, with a power of at least 80 kW. A detailed description, appearance and parameters of the chargers have been established in the SWZ (hereinafter "Charging Stations" or "Chargers"). In terms of the execution of the Subject of the order, the Contractor: (1) undertakes to deliver 4 units of electric buses offered in the procedure 1/UE/2025 to the registered office of Miejski Zakład Komunikacyjny sp. z o. o. in Żagań, at ul. Młynarska 6, 68-100 Żagań, unless the Contracting Authority, no later than the day before the planned acceptance, indicates another location within the city of Żagań to the Contractor. (2) undertakes to conduct Service Training, including granting authorization, and User Training in accordance with the provisions of Annex No. 1 to the SWZ – OPZ. (3) undertakes to deliver and install two dual-output mobile charging stations for electric buses, with a power of at least 80 kW. A detailed description of the subject of the order concerning all elements included in the Subject of the order is included in Annex No. 1 to the SWZ – OPZ. 1 The public procurement procedure is conducted in the form of an open tender, based on the Act of September 11, 2019 – Public Procurement Law (Journal of Laws of 2024, item 1320 as amended) [hereinafter also referred to as "Pzp"]. 2 The Contracting Authority will apply the procedure referred to in art. 139 sec. 1 Pzp (i.e., the so-called reverse procedure). 3.3 Due to the application of the procedure referred to in art. 139 sec. 1 Pzp, the Contracting Authority does not require the submission of a declaration along with the offer, referred to in Chapter X, point 12.2 of the SWZ. The Contracting Authority will request the submission of this declaration only from the Contractor whose offer has been assessed highest. 4 If there are grounds for exclusion against the Contractor whose offer has been assessed highest, this Contractor does not meet the conditions for participation in the procedure, does not submit subject-specific evidence or a declaration referred to in Chapter XII, point 12.2 of the SWZ, confirming the absence of grounds for exclusion or meeting the conditions for participation in the procedure, the Contracting Authority will re-examine and evaluate the offers of the remaining Contractors, and then carry out a subjective qualification of the Contractor whose offer has been assessed highest, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the procedure. 5 The Contracting Authority continues the procedure referred to in point 4 until the selection of the most advantageous offer or the annulment of the procurement procedure. 6 The Contracting Authority does not allow partial offers. Justification: The inability to submit partial offers is justified by the Contracting Authority's need due to the specificity of the subject of the order, minimizing the risk of excessive increase in the cost of order execution, difficulties and complications for the contracting authority resulting from the execution of the order by different contractors.
