Delivery and installation of two walk-in climatic chambers for IHAR-PIB, Poznań Branch

1. The subject of the order is the delivery and installation of two walk-in climatic chambers for IHAR-PIB, Poznań Branch. The scope of the order includes delivery to the Contracting Authority's registered office, transport including unloading, installation (assembly), connection, commissioning (the product must be ready for operation without the need to purchase additional equipment or software), carrying out load tests (validation) and handing over the necessary documentation and training the Contracting Authority's personnel in its operation and maintenance (max. 6 employees). 2. A detailed description of the subject of the order is included in the Description of the subject of the order (attachments No. 1 to SWZ). 3. The procedure is conducted in the form of an open tender, in accordance with art. 132 of the Act of September 11, 2019, Public Procurement Law (consolidated text: Journal of Laws of 2024, item 1320 as amended), hereinafter referred to as the "Act" or "uPzp", with an estimated value equal to or exceeding the "EU threshold" within the meaning of art. 3 of the Act. 4. The order to which this procedure relates has not been divided into parts. Dividing the subject order into parts would be unjustified for technical, organizational, and expediency reasons. The Contracting Authority does not allow the submission of partial offers, as it is not justified due to the specifics of order execution. Due to the need to coordinate the scope of the order within a very short implementation time, dividing the order into parts would risk generating excessive organizational and technical difficulties. The need to coordinate the actions of various Contractors carrying out individual parts of the order could seriously jeopardize the proper execution of the order. The failure to divide the order into parts was therefore dictated by technical, organizational reasons and the nature of the subject of the order. The possible division of the order into parts would not increase competition in the small and medium-sized enterprises sector – the scope of the order is a typical scope, allowing companies from the small or medium-sized enterprises group to submit an offer. In accordance with the content of recital 78 of the preamble to Directive 2014/24/EU of the European Parliament and of the Council of February 26, 2014, on public procurement, repealing Directive 2004/18/EC (OJ EU L of 2014, No. 94, p. 65, as amended), the contracting authority should have the obligation to consider the expediency of dividing contracts into lots, while retaining the freedom to make autonomous decisions on any grounds it deems appropriate, without being subject to administrative or judicial supervision. 5. If, when describing the subject of the order, the Contracting Authority refers to standards, technical assessments, technical specifications, and technical reference systems referred to in art. 101 sec. 2 and 3 of the Pzp Act, equivalent solutions to those described are permitted. Any phrase in the SWZ referring to standards, technical assessments, technical specifications, and technical reference systems should be read with the accompanying note "or equivalent". 6. In the event that indications of trademarks, patents, or origin appear in the description of the subject of the order, they should be understood in accordance with art. 99 sec. 5-6 of the Pzp Act, that this is justified by the specifics of the subject of the order and the Contracting Authority cannot describe the subject of the order using sufficiently precise terms. In such circumstances, the Contracting Authority permits the possibility of submitting equivalent solutions in the offer, indicating that the minimum requirements that equivalent solutions must meet are requirements (functionalities) no worse than the parameters (functionalities) indicated in the Description of the subject of the order. 7. The Contractor who refers to solutions equivalent to those described by the Contracting Authority is obliged to indicate in the offer which offer items contain equivalent solutions along with their description or standards and to demonstrate that the equivalent solutions offered by him meet the requirements specified by the Contracting Authority, in particular by means of the subject...
