Delivery of diesel fuels with the possibility of emergency distribution at the Ordering Party's premises. (repeat)

3.1. The subject of the order is the successive delivery of diesel fuel, including the possibility of emergency distribution at the Ordering Party's premises, the basic order in the amount of 2,460 m3, including: - standard diesel fuel in the estimated amount of 2,400 m3 (grades B, D, and F); - diesel fuel with improved low-temperature properties in the amount of 60 m3 (fuel class 2 for arctic or severe winter climate). and an order executed under the option right up to 492 m3. 3.2. Order execution term - 24 months from the date of signing the contract, with the first delivery planned for 01.06.2026, with the possibility of extension under the conditions specified in the contract. 3.3. The indicated amount of diesel fuel is an estimated quantity and may change depending on actual needs. The Ordering Party reserves the right not to use the entire order within the period covered by the contract, while guaranteeing the execution of the order at a level of at least 65% of the gross contract value. 3.4. The Contractor guarantees that the fuel sold will meet the quality requirements specified in the Regulation of the Minister of Climate and Environment of June 26, 2024, on the quality requirements for liquid fuels (Journal of Laws of 2024, item 1018, as amended) and the requirements specified by the valid standard PN-EN 590:2022-08 (Motor vehicle fuels – diesel fuels – requirements and test methods) or equivalent. The Contractor shall provide a quality certificate for the diesel fuel issued by an accredited laboratory with each delivery. 3.5. The Contractor will deliver diesel fuel to the fuel station tank of the Ordering Party at ul. Górecka 104 in Poznań, between 7:00 AM and 1:00 PM, within 24 hours of placing the order. 3.6. The Contractor will deliver diesel fuel using transport means (tankers) that meet the standards provided for in environmental protection regulations. 3.7. The place of delivery of diesel fuel is the tank at the fuel station located on the premises of the Ordering Party's base, at ul. Górecka 104 in Poznań. 3.8. The Ordering Party's tank is calibrated. The tank has the legally required features and calibration dates and meets the requirements specified in the Regulation of the Minister of Climate and Environment of July 24, 2023, on the technical conditions that bases and liquid fuel stations, liquefied petroleum gas bases and stations, and long-distance transmission pipelines for the transport of crude oil and petroleum products and their location should meet (Journal of Laws of 2023, item 1707, as amended). 3.9. The quantity of diesel fuel will be measured using calibrated measuring devices that comply with the provisions of the Regulation of the Minister of Economy of January 22, 2008, on the requirements that measuring tanks should meet and the detailed scope of tests and checks performed during the legal metrological control of these measuring instruments (Journal of Laws of 2024 consolidated text, item 1467, as amended). 3.10. The delivery will be received (handed over) according to the rules and conditions specified in the contract by authorized representatives of the Ordering Party and the Contractor, who will draw up a delivery protocol for the activity. The basis for issuing a VAT invoice will be the quantity of diesel fuel consistent with the delivery protocol; the quantity will be compensated to a reference temperature of 15 degrees Celsius. 3.11. With each delivery, the filling and discharge valves of the tanker must be sealed, and the seal numbers must be entered in the delivery document. The seals can only be opened in the presence of an authorized employee of the Ordering Party.
