Delivery of diesel fuel for Miejski Zakład Komunikacji S.A. in Ostrów Wielkopolski

1. The subject of the order is successive wholesale deliveries of diesel fuel according to the currently binding Polish Standard PN-EN 590 or an equivalent standard, in a quantity not exceeding 1200 m3, taking into account point 3. 2. The type of diesel fuel supplied must be adapted to the existing climatic conditions during the term of the contract. 3. The Ordering Party reserves the right to reduce the quantity of diesel fuel ordered within the contract, depending on the needs arising from current transport tasks, with the reservation that the ordered quantity of fuel will not be less than 1000 m3. In the event of a quantity reduction, the Contractor is not entitled to any claim against the Ordering Party. 4. The supplied diesel fuel must meet the requirements specified in the regulation of the Minister of Climate and Environment of June 26, 2024, on quality requirements for liquid fuels (Journal of Laws of 2024, item 1018). 5. In the event of a change in the provisions referred to above or their replacement with other provisions, the supplied diesel fuel must meet the requirements resulting from the provisions in force on the day of delivery. 6. In the event that the description of the subject of the order or technical documentation contains a reference to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Public Procurement Law, the Ordering Party admits equivalent solutions, i.e. those that guarantee the implementation of the subject of the order in accordance with the description of the subject of the order and ensure the achievement of technical parameters no worse than those assumed in the aforementioned documents. In the event of intending to use equivalent solutions, the Contractor is obliged to indicate these solutions along with the offer and prove, by any means of evidence, that the proposed solutions meet the requirements specified in the description of the subject of the order to an equivalent extent. The burden of proving equivalence lies with the Contractor. In the described situation, the aforementioned documents will constitute the subject-matter evidence. 7. Pursuant to Article 107(2) of the Public Procurement Law, if the Contractor does not submit the subject-matter evidence referred to in point 6 or the submitted subject-matter evidence is incomplete, the Ordering Party will request its submission or supplementation within the specified period, subject to Article 107(3) of the Public Procurement Law. 8. The method of delivery is described in the draft contract constituting Appendix No. 4 to the SWZ.
