Auto-translated from Polish6. DESCRIPTION OF THE SUBJECT OF THE ORDER 6.1.1. The subject of the order includes the basic order and the optional order referred to in art. 441 sec. 1 of the Pzp Act. The order has not been divided into parts, as the essence of the implementation of this project is the delivery of network switches along with implementation and ensuring equipment warranty, which for the safety and execution of this undertaking should be carried out by the same Contractor. 6.1.2. The subject of the basic order is: 1) delivery to the Ordering Party's registered office of two types of switches dedicated to handling traffic in the data processing center, from a single manufacturer, hereinafter referred to as "Equipment", in the following quantities: a) switch Type 1 – 20 pieces along with the necessary software guaranteeing the functionality required by the Ordering Party specified in the Technical Specifications, b) switch Type 2 – 12 pieces along with the necessary software guaranteeing the functionality required by the Ordering Party specified in the Technical Specifications, 2) implementation of the Equipment, consisting of configuring the delivered Equipment with the Ordering Party's infrastructure in accordance with the requirements described in the Technical Specifications, 3) execution and delivery of as-built documentation of the Equipment implementation, in accordance with the requirements specified in the Technical Specifications, 4) granting warranty and guarantee for the delivered Equipment, on the terms specified in the Technical Specifications, for a period of at least 36 months (according to the Contractor's Offer - Warranty Period is a criterion for evaluating offers), counted from the date of signing the Implementation Acceptance Protocol without reservations, - within 60 days from the conclusion of the contract. 6.1.3. The subject of the optional order is: 1) delivery of Type 1 or Type 2 switches, referred to in point 6.1.2.1) of the IDW, along with the necessary software guaranteeing the functionality of the Equipment configured with the Ordering Party's infrastructure, required by the Ordering Party (in the Technical Specifications), 2) with a total value not exceeding PLN 200,000.00 gross, 3) commissioned by the Ordering Party through one or more partial orders, within 12 months from the date of concluding the contract for the execution of the basic order, 4) each carried out within 90 days from the date of commissioning, 5) through the delivery and implementation of the Equipment, execution and delivery of as-built documentation and granting of warranty within the scope and on the terms mentioned in points 6.1.2.2) – 4) of the IDW. 6.1.4. The Ordering Party requires that the manufacturer of the offered switches within the basic and optional order be classified in the leaders' quadrant of core switch manufacturers of Type 1 and Type 2 in the Wired/Wireless LAN Access Infrastructure category of the Gartner Magic Quadrant report (or equivalent) in the last 5 years. As equivalent to the Gartner report, the Ordering Party will also allow another report: • publicly available, • generally accepted, • external and objective market report concerning Firewall devices, • which provides analysis, insight into the direction and maturity of market participants in Wired/Wireless LAN Access Infrastructure solutions, - updated and published annually for at least 5 years. 6.1.5. The Ordering Party requires that all delivered Equipment and software, within the scope of the basic and optional order, come from a sales channel authorized by the manufacturer and requires that a certificate of product legality or other document issued by the manufacturer or authorized representative of the manufacturer be attached to the offer - confirming that: 1) the supplier is an authorized partner, and 2) has support from the manufacturer or authorized representative of the manufacturer, and 3) the Equipment offered to the Ordering Party comes from an authorized and legal sales channel of the manufacturer or authorized representative of the manufacturer. 6.1.6. The Equipment delivered within the scope of the basic and optional order must be manufactured by a single manufacturer and be brand new, i.e., manufactured no earlier than 12 months before delivery to the Ordering Party and not used.
