Delivery of a mobile stage with a roof for the needs of the Szczuczyn Commune within the project entitled "New space – new opportunities".

The subject of the order is the delivery of a brand new, complete, mobile outdoor stage with a roof (usable area of at least 6 m x 4 m), intended for multiple assembly, disassembly, transport, and use during outdoor, cultural, artistic, sports, promotional, and other events organized by the Ordering Party. The order includes the delivery of a complete set with all elements necessary for proper assembly, stabilization, disassembly, transport, and use of the stage, in accordance with the technical specification attached to the inquiry. All elements of the set must be compatible with each other and form a complete stage system. The offered subject of the order must be brand new, free from physical and legal defects, and ready for use as intended after the assembly operations specified by the manufacturer. Contract amendment conditions: 1. The parties allow for changes to the contract provisions compared to the offer based on which the Contractor was selected, in the event of an objective necessity to introduce a change: 1) change of the proper name of the Subject of the contract – in cases of cessation or suspension of production by the manufacturer of the Subject of the contract offered by the Contractor, if the Contractor, despite due diligence, could not obtain such information until the conclusion of the contract. In such a case, the Contractor must demonstrate that they have exercised due diligence to obtain information from the manufacturer regarding the continuation or cessation or suspension of production of the offered subject of the order and offer in return a Subject of the contract with no lower technical parameters and functionality meeting all the requirements of the subject of the order description at an unchanged price; 2) changes to the elements of the Subject of the contract and/or equipment related to technological changes may occur in the event of the appearance on the market of newer generation materials and/or devices that allow for improvement of technical or operational parameters or reduction of operating costs related to the use of the Subject of the contract at an unchanged price, 3) changes in the method of contract performance for justified technical or functional reasons, 4) changes in generally applicable legal provisions affecting the performance of the subject of the contract, 5) changes in the Contractor's data (e.g.: change of registered office, address, name). 2. A change in the contractual deadline for the completion of the subject of this Agreement is possible in the following cases: 1) in the event of circumstances beyond the control of the Contractor and the Ordering Party, resulting in the temporary suspension of the contract execution due to the actions of third parties, unforeseen situations that could not have been foreseen despite due diligence, 2) suspension of contract execution due to force majeure, confirmed by a person designated by the Ordering Party, provided that the duration of the suspension of contract execution and its scope will result in an extension of the order execution deadline – for the duration of this suspension of contract execution. Force majeure is understood as the occurrence of an extraordinary, external event, impossible to predict and prevent, which could not have been avoided even with the utmost diligence, and which prevents the Contractor from fulfilling its obligation in whole or in part. In particular, these are events and circumstances such as: natural disaster, acts of war, rebellion, terrorism, epidemic, pandemic, revolution, uprising, invasion, riot, strike caused by persons not related to the execution of the subject of the contract.
