"Delivery of a tractor - multifunctional mower with accessories (flail mower and disc mower) as part of the project FEPK.07.08-IP.01-0107/25 "Gmina Przemyśl Municipality - a workplace friendly to all employees".

1) The subject of the order is: delivery of a brand new, complete, unused tractor - multifunctional mower with accessories including: • flail mower, • disc mower. The equipment must meet the requirements specified in the Detailed Description of the Subject of the Order, which is Annex No. 2 to this tender request. Technical requirements result from the specification prepared for the project and include, among others: 2WD/4WD drive, electric start, 459 cm³ gasoline engine, front and rear PTO, 12 V electric lift, LED lighting and required accessories. Supplementary orders: not applicable Conditions for amending the contract: Contract amendment 1. Amendments to the contract provisions may only occur in cases provided for in this paragraph, while observing the principles resulting from the Guidelines on eligible expenditure for the years 2021-2027 and legal regulations. 2. All contract amendments require written form in the form of an annex signed by both Parties, under pain of nullity, subject to sec. 13. 3. The contract implementation deadline may be amended in case of: 1. force majeure preventing the performance of the contract subject within the deadline; 2. occurrence of circumstances independent of the Parties, which could not have been foreseen on the date of concluding the contract, despite due diligence; 3. delay resulting from the Ordering Party's actions or omissions affecting the contract implementation; 4. necessity to introduce changes resulting from decisions of the Managing Institution, Intermediate Institution or other authorized bodies; 5. temporary suspension of the order execution for reasons beyond the Contractor's control. 4. The offered model of the device may be changed only in case of: 1. termination of production of the offered model; 2. withdrawal of the model from the market; 3. permanent unavailability of the model from the manufacturer. The change is permissible only if: o the new model has technical, usability and functional parameters no worse than those specified in the Description of the Subject of the Order and the Contractor's offer, o it does not increase the Contractor's remuneration, o it is accepted by the Ordering Party. 5. The identification details of the Parties may be changed, in particular: 1. name, 2. registered office address, 3. bank account number, 4. contact details, 5. persons designated for contract implementation. 6. Remuneration may be changed only in case of: 1. change in the statutory VAT rate affecting the gross remuneration amount; 2. other changes in generally applicable law, if they have a direct impact on the contract implementation and the amount of remuneration due. 7. The remuneration change referred to in sec. 6 may not lead to an increase in the net value of the contract. 8. The method of performing the subject of the order may be changed if: 1. the change is beneficial to the Ordering Party; 2. it results from technological progress; 3. it is necessary to ensure compliance with applicable legal regulations; 4. it does not lead to a deterioration of the technical, quality or functional parameters of the subject of the order; 5. it does not lead to a change in the nature of the order. 9. The contract implementation schedule may be changed if it does not result in a change in the scope of services or an increase in the Contractor's remuneration. 10. Each contract amendment requires written justification indicating: 1. circumstances justifying the amendment; 2. legal basis for the amendment; 3. impact of the amendment on the contract and project implementation. 11. Contract amendments may not violate the principle of fair competition, equal treatment of contractors, or circumvent the public procurement rules applicable in projects co-financed by European Union funds. 12. In cases where a contract amendment requires the consent of the Managing Institution, Intermediate Institution or other authorized entity, it will be made after obtaining the required consent, if the obligation to obtain it arises from legal regulations, guidelines or the provisions of the co-financing agreement. 13. Amendments regarding: 1. persons designated for contact between the Parties; 2. telephone numbers; 3. e-mail addresses; 4. bank account numbers; 5. other organizational data not affecting the scope of services, remuneration amount or contract implementation deadline. The Parties are obliged to inform each other about these changes in writing or electronically. 14. A contract amendment made in violation of the provisions of this paragraph is invalid.
