Supply of various food products, spices and herbs, and powdered soups.

1. The subject of the order is "Supply of various food products, spices and herbs, and powdered soups to the Police Academy in Katowice"; The full list of assortment items and the maximum quantity of ordered products are provided in the assortment-quantity-value specification, which is Annex No. 1A to the SWZ. Failure to complete column No. 3 of the aforementioned specification (Annex 1A) or proposing products that do not meet the Contracting Authority's requirements will be equivalent to rejecting the Contractor's offer pursuant to Art. 226 sec. 1 item 5 of the Pzp Act – as not complying with the order conditions. 2. The quantities provided are estimated amounts and do not oblige the Contracting Authority to purchase products in these quantities. 3 The Contracting Authority reserves the right not to fulfill the subject of the order with a value of up to 50% of the total gross remuneration. The Contractor is not entitled to any financial or legal claims due to the non-fulfillment of part of the order. 4. Delivery, unloading, and carrying of the subject of the order will be carried out at the Contractor's expense, included in the price of products covered by the public procurement contract. 5. Delivery of the subject of the order will be carried out using the Contractor's transport means approved for food transport. 6. To confirm that the offered supplies meet the specified requirements, the Contracting Authority requires the Contractor to submit product cards or other documents along with the offer, from which their composition and compliance with the requirements specified by the Contracting Authority in the Assortment-Quantity-Value Specification will be evident, constituting: 1) For part 1 – Annex No. 1A to the SWZ – in positions: 1, 2, 7, 8, 9, 10, 14, 25, 26, 27, 31, 33, 41, 42, 43, 48. 7. Persons performing the delivery must have a current medical certificate for sanitary and epidemiological purposes, which they present upon request of the Contracting Authority. 8. The Contractor is obliged to have a current certificate of registration in the register of establishments subject to official control by the competent authorities – in accordance with the Act of August 25, 2006, on food and nutrition safety (consolidated text of Journal of Laws of 2023, item 1448) or a current administrative decision on registration in the register of establishments or approval of the establishment issued by the district veterinarian along with the assigned identification number in accordance with Art. 21 sec. 4 of the Act of December 16, 2005, on products of animal origin (consolidated text of Journal of Laws of 2023, item 872). The Contractor must be under the constant supervision of the competent authorities. 9. The offered products must meet the requirements specified in the applicable legal regulations regarding the production and trade of food. Each product must be produced and placed on the market in accordance with the requirements of the HACCP system. 10. Details of delivery implementation are specified in the draft agreement, which is Annex No. 5 to the SWZ.
