Auto-translated from Polish1. Subject of the contract. 1.1. The subject of the contract is the sale and delivery of a maximum of 35,000 tons of stowing sand for hydraulic stowing of class II. 1.2. The delivered stowing sand should meet the quality requirements specified in standard PN-93/G-11010 or equivalent solutions. If the Contractor offers sand delivery based on solutions equivalent to those in standard PN-93/G-11010, they are obliged to indicate these solutions in the offer instead of this standard and attach documents confirming the equivalence of the offered solutions. 1.3. The delivered sand must not contain visible impurities and plant parts, and during winter, the sand must be in a loose state. 1.4. The Contracting Authority will consider the following sand parameters as equivalent when other aggregates/sands with a dominant mineral component, e.g., carbonate, granite, meet all requirements for typical quartz sands, and in particular meet the requirements: 1) water permeability – at least 0.002 cm/s, 2) content of grains with dimensions below 0.1 mm – at most 15%, 3) largest grain size (agglomerated) – 60 mm, 4) compressibility at a pressure of 15 MPa – at most 7%, 5) bulk density (in loose sand state) – at least 1.3 kg/dm3. 1.5. The sand delivered by the Contractor will be used by the Contracting Authority as raw material for mining stowing operations in the Wieliczka Salt Mine and will be transported to the underground workings of the Wieliczka Salt Mine using a hydrotransport system. 1.6. For the delivered sand, the Contractor is obliged to possess documentation of tests performed by a scientific unit within the meaning of art. 2 point 9 of the Act of April 30, 2010, on the principles of financing science, confirming that the sand meets the requirements for quality class II, in accordance with standard PN-93/G-11010 or equivalent solutions. 1.7. The Contractor is obliged to provide the Contracting Authority with the documentation referred to above upon every request from the Contracting Authority, within 7 days from the date of receipt of the written request. The documentation may be presented as a copy confirmed for conformity with the original by the Contractor. Upon request from the Contracting Authority, the Contractor is obliged to make the original documentation available for inspection. 1.8. The Contractor undertakes to allow the Contracting Authority to conduct quality control of the sand delivered to the Contracting Authority at its own expense, covering, among other things, whether it meets the requirements for quality class II in accordance with standard PN-93/G-11010 or equivalent solutions. 1.9. In the event that the sand does not meet the requirements mentioned above, the Contracting Authority will be authorized to withdraw from the contract. 2. Delivery conditions. 2.1. Conditions for purchase and delivery of sand: 1) Sand deliveries should be made by tipper trucks or semi-trailer tipper trucks at the Contractor's expense. 2) Loading and unloading of sand should be at the Contractor's expense. 3) Maximum daily sand delivery quantity: up to 500 tons. 4) Place of delivery: Kopalnia Soli „Wieliczka” S.A., 32-020 Wieliczka, ul. Jedynaka 3. 5) Stowing sand should be delivered on working days from Monday to Friday between 6:00 AM and 2:00 PM. Deliveries between 2:00 PM and 8:00 PM on working days from Monday to Friday are permitted at the explicit request of the Contracting Authority, submitted a week in advance in the delivery schedule referred to in point 6 below. 6) Sand deliveries will be made based on weekly schedules, which will be prepared by the Contracting Authority and sent electronically to the Contractor at least 2 days in advance. In case of failure of the stowing unit, the Contracting Authority reserves the right to cancel a delivery with 1 day's notice. 7) Individual deliveries of stowing sand must be accompanied by a delivery note specifying: sand class, sand quantity, bulk density, vehicle registration number, driver's name, and date and time of loading. 2.2.
